I don't agree with the decision because,i've been diagnosed with all these conditions.I have had all these conditions since before i got out of the military.

ou should always appeal, and make sure not to be employed. Although online it says you can make up to 1,300 approx a month; for they may turn husband down. And make sure you get lawyer when applying for disability

What does a 15 month turn around mean at an reconsideration appeal level?

Hi Tamerra,
The average wait time for an appeal is usually around 17 months. It really doesn't mean anything beyond being how long it takes to have an ALJ hearing.

I AM 49 AND WAS IN A CAR ACCIDENT 4YRS AGO AND I WAS RECIEVING SSI AND JUST RECIEVED A LETTER SAYING THEY ARE GOING TO STOP MY CHECKS BECAUSE RTHEY SAID MY CONDITION HAS IMPROVED WELL I HAD A HOLE BUNCH OF TESTING DONE AND I STILL HAVE NO USE OF MY RT ARM DUE TO THE ACCIDENT MY ELBOW IS CEMENTED INTO PLACE AND DOES NOT BEND THEY DOCTORS THAT THEY CONTACTED I HAD ONLY SEEN 1 TIME HOW CAN THEY SAY MY CONDITION IMPROVED WHEN THEY DONT EVEN NO MY CASE.I FILED A APPEAL SHOULD I GET A LAWYER IS MY QUESTION

My son has been ssi since age of 3 they recently did a review and defined him saying his health has improved he has cystic fibrosis 2 lung function test showed good how can they denie him when it's a life threating disease I did ask for a reconsideration what happens now?

Hi there,
If they asses your child is not eligible due to improvement, your child may still be eligible for Medicaid, however he may become ineligible for benefits.

I received disability approval but no lump sum. I refile the case instead of appealing. I didn't know what to do. Can I file an reconsideration claim for lump sum.

Hi Dee,
You may have been found ineligible for the lump sum due to certain circumstances, and as you have already been approved for benefits your application may not be processed.

I filed for disability last June. Was denied in Nov 2016. Said I was disabled, but would not last. This was after a meniscus removal and debriment of left knee leaving me at 30 % space loss. I put in for reconsideration in December. I went back to my orthopedic surgeon and have 80% loss in left knee, walking with cane and he states in his report nothing else he can do to improve function due to hip muscle tearing and ITB irritation that consistent puts strain on leg. Given my age a knee replacement is only fix but much too young at this point and should try to reduce issues that cause decrease in cartlige loss. So after 20 yrs in a factory and development of plantar fasciitis in both feet, stress fractures in top of foot, osteoarthritis in both ankles, osteoarthritis in left knee that has went from 30 to 80 percent since denial....How will this affect my reconsideration decision. BTW I am 42. My main issues are all left lower limb... With DDD in neck and back as well. Thank you.

Hi Bryan
I received a denial letter on case above. Said I did have restrictions on daily living, but because of my age it did not keep me from work. Now awaiting a hearing. My orthopedic doctor says only plan he has is knee replacement, but my age causes major risk because I will undergo 3 replacement before age of 80. Each replacement is possible infection and possibly loss of limb. I sent photos of my leg showing deformity​ and flexion contracting of leg/knee to the ALJ. I have all the blue book muscle​ skeleton issues required for disability approval. Regardless of my age I do indeed have this blue book required symptoms. Sitting, standing from seated position, keeping balance, walking up steps, down steps, use a cane full-time, must change position often and many other ways I adhere to daily are part of my leg issues. So my question is being all these issues explained and evidence for them what can be the denial explanation? My age shouldn't be a factor when the evidence shows medical purposes for the approval?? What employee is going to hire a risk such as mine in standing, loosing balance, changing positions all day and using a cane. What if I loose balance while standing to get a copy of something at a office for a secretary position? Are they going to chance an injury on their workman's comp insurance? I recently lost my balance in the kitchen, grabbing the counter knocked a heavy glass bowl off and broke my middle toe. That said, what are my chances of being approved at hearing level?

Hi There,
They may have determined based on the information that you have given them that you were ineligible for benefits, if you are over full retirement age you would be ineligible for benefits as the program only insures those under full retirement age. If you are under retirement age, it may be because they have determined that you are able to work in some capacity. I really could not say what your chances are, but you may want to speak with a adisability advocate or attorney. You can get in touch with one by filling out this form:

The medical examiner who is handling my disability appeal advised me to not hire an attorney because it would be a waste of money for me. Was this her way of hinting that I have been approved?

Hi Sherwin,
The SSA hires independent medical examiners, as such even though you may medically qualify, they may not be able to say that you'd be approved because there are technical qualifications as well. It may be a good idea to at least speak with a lawyer about your case, you can get in touch with one in your area by filling out this form:

I applied for SSDI March 2011, we took my case to court to sue and won. In the mean time I was told to file again in case we didn't win in Federal court. We won and it was sent back to hearing Judge in 2016. I had my hearing and judge said she had to consolidate cases and I was found favorable as of March 2011. However payment center only did back pay from Dec 2013. They keep saying they can't pay more than a year back but I won 2011 and case was never closed. What do I do

Hi Wendy,
Back pay would only be paid a year back from the time that you were found disabled by the SSA. Your Established Onset Date may have been from that second application rather than the first one.

I was denied SSI in 12/16 because of income, I submitted reconsideration 1/30/17 because income has decreased a lot and gave proof of medical expenses, pay stubs, FMLA paperwork from my doctor backing up my diagnosis "disability" and medical records I have not received or heard of any update. I've gone to ssi office and they say the paperwork is in there system pending. How much longer is it going to take? I've called DDS office as well and they say they do not have anything in their system for me.
