SSI & credit card debt

Hello,

I currently receive SSI (I'm an adult and I live in VA) and am having problems making my credit card payment each month now because of the interest. I have seen on other sites that it's ok if a family members pays off the card for you if they directly pay the bank and not give the money to you, that it will not affect your SSI. Was wondering if there was any truth to this? I would rather not file bankruptcy and ruin my credit. Thanks!

Hi there,
I'm sorry to hear that! Some types of support that you can get from family members count as "in-kind support and maintenance"(ISM). I'm not entirely sure if a family member paying a credit car bill counts as ISM, you may want to contact your local SSA office regarding this, they can better clarify if this type of aid would be considered ISM.

I had just read earlier today that if a family member pays your credit card debt than that counts as an income to you and could be deducted from your SSI

My adult daughter receives SSI for her disability. I am her Payee. She received an old bond from her grandmother for over 12, 000. I am told that she must spend that money down to maintain her eligibility.

She has a few old medical bills that she can pay, and my booklet says she can buy household furnishings, appliances, clothing, etc.

Can she reimburse me for travel expense of transporting her to her doctors ( they are 140 miles round trip and she has severe epilepsy and cannot drive herself). ?

Can she reimburse me of other expenses like paying for her dogs knee surgery last month? Or taking her to Mayo Clinic and Cleveland Clinic 3 years ago?

Are there limits on how much she can spend on clothing, furniture, etc.?

Hi Jill,
Payee reimbursements are an expense, however they are restricted to certain things for certain types of payees. You may want to contact the SSA regarding this.

I am disabled by both Federal and State and receiving SSI, food stamps, medicaid health insurance. I have 3 outstanding cc balances of about 3k each. I just havent been paying because I couldnt any longer. cc company is taking me to court, what to do? I have no asssets or resources.

I've met with an advocate attorney (no cost to me) to help me with my credit card debt. The attorney told me that I don't have anything to worry about because I'm judgment proof. SSI can not be garnished, and with that being said, credit card companies will not be able to get any court in the United States to garnish your SSI. The credit card companies may try to sue you, but they won't be able to touch your SSI. The attorney informed me that I should wait for the credit card companies to sue me and then file for bankruptcy. Find your nearest state legal aid advocate!

Hi,

Am I allowed to make credit card debt payments with SSI? I am thinking about getting a GAP card to buy clothes (I cannot otherwise afford clothes), then I would need to pay the bill off monthly. I want to know if I must use my SSI strictly for rent, utilities, and food, or if I'm legally allowed to use a portion of it to make minimum monthly payments on credit card debt. Thank you. I live in Georgia, if that info is needed.

Hi Adam,

You can use it for clothing. However, since you're getting a store credit card, I would recommend checking in with the SSA before doing that. Better safe than sorry.

I have several credit cards, and I pay my credit card bills with my SSI. I have never gotten into any trouble for that. However, I did ask Social Security about using credit cards, and the social security rep told me it's ok to have and use credit cards as long as the credit cards create debt that you have to and intend to pay back, and it's definitely ok to make monthly credit card payments with SSI. You can even get a loan, a pay day loan, or even a cash advance being on SSI; again, it has to create a debt that you have to and intend to pay back to the creditor(s). Therefore, you can go ahead and pay your credit card bills with your SSI without any worry about it affecting your SSI. Just be careful not to end up deep in credit card debt where you end up not having enough $ to make the minimum payments.
