Waiting for decision

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Hi ive been before an ALJ 12/14/16 I did not have respentation but i did have documents of doctors ruiling out of work! The ALJ ask for more info i sent what she ask for in. The last piece of info wasn't recieved until 04/15/17. Its been six in a half months with no decision.. What the lenght of the decision process? Is this normal to wait way longer than usual?

Hi Lazavier,

Unfortunately, this is a very long process. Every ALJ decision wait time varies by city/state so I cannot say for sure what the length is.

Hi all, I just had my case heard a week ago. I suffer from Cystic masses on the head of my pancreas,Chronic pancreatitis, Diabetes type 2 Cirrhosis of liver, aorticial (?) hardening of arteries, cysts on kidneys, enlarged liver gall bladder, spleen all of which have left me in severe daily pain, for which I must take oxycontin 80mg (cr) and Morphine 8mg both I must take twice a day or I need to go to the hospital for them to get the pain under control. Ok so I had a lawyer and we went to my hearing and the judge asked me like 8-10 questions? I was expecting a whole lot more questions, I filed in 2012 and again in 2015, so this has been going on for almost 9 years now....ok my question is this......why didnt she ask me more questions? None of her questions were challenging at all, I got this overall feeling at the hearing that she had already decided if I was disabled or not b4 we even met.......and then to ask me so few questions, that if she had a doubt? She didnt ask enough questions to decide, or to challenge me I guess. My lawyer said he not familiar with this judge but she has a decent approval rating? I hope I made sense here and didnt confuse anyone. But I mean what does it look like in your minds? Im just looking for anyones opinion, no matter what it is. :-) Thanks very much!

If I've already had my disability hearing, how quickly would I receive my denial letter opposed to if I were approved ?

Hi Jeannie,

Generally, those who are denied benefits receive their notice fairly quickly because they have to meet the 65-day deadline for filing an appeal.

I am too going on 2 1/2 years waiting For hearing. I am only 34 but only have 1 kidney and in renal failure stage 4.And autoimmune disorder. And stay in hosptials due to infections. It's horrible and being a single mom I keep losing jobs because of constant dr and hosptial stays. I thought renal failure was automatic. Guess nkt

I Had My Hearing A Little Over A Month Ago Still Waiting On A Decision At The Hearing I Had Extreme Anxiety And Panic Disorder Could Barely Speak And The Judge Was Asking Questions That I Fully Disagreed With But I Was So Nervous That I Agreed With What She Said I Go To A Psychiatrist For Major Depression Disorder And Take Medication The Judge Really Didn't Discuss MY DEPRESSION Nor My Anxiety It Hard For Me To Be Around People Due To My Depression And My Prosthetic Eye That Was Never Discussed And My Lawyer Never Spoke Up Are Prepared Me Before The Hearing Now I Am Extremely Depressed Which I Discussed With My Psychiatrist Because I Been Waiting Over A Year In a Half to Go to Court Now I'm Still Waiting And Think I'm Going To Get a Unfavorable Decision Because My Extreme Anxiety In Court I Am 56 yrs Old And I Am Disabled Due To My Eyesight And Depression And Anxiety What Are My Chances Of Winning I Am Afraid What The Decision Might Be

It's Been Over 60 days Since My Hearing Still Haven't Heard Anything My Lawyers Office Says Judge Had Not Made Decision Yet Its Still Pending Is This a Bad Sign For a Denial vs Approval ?

It's tough to say, though those who are denied generally receive their letter sooner because they only have a certain amount of days to appeal.
