Waiting for decision

Submitted by Anonymous (not verified) on

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Hi Jade,

Unfortunately, there is no set length of time that it will take once it is now with the decision writer.

Best of Luck,
Eric

Hello,

Its been 43 days since I had my hearing before the ALJ. My lawyer as well as myself were present. When the hearing was over, the judge told me it will take 6 to 8 weeks before he have a decision. My lawyer stated I did well at the hearing and when she is notified about the case, she will let me know. I am still waiting patiently. It get hard at times, but I try to put the best on the outside. I applied for disability back in October 2013. My husband is the only one working and I see how he struggles to pay all our bills. Eviction notices after eviction notices. In 2016 I tried to go back to work even though I applied for disability. That didn't last long, not even 3 months, but I tried. Even though I worked that period of time, will it have a negative impact on my disability case?

Hi Sabrina,

It's tough to say because every case/judge is different. Wishing you nothing but the best.

Our hearing was over a year ago still no decision. We've called the ODAR, we've sent a letter to the HOCALJ. Still haven't heard anything. Who holds them accountable, FEDS next?

My son had his hearing june 27th and a decision was mailed out on the 11th of July. I haven't received it yet. Does this mean it was denied?

Hi Rebekah,

That's not necessarily the case though. There's no black and white answer to that question. Wishing you and your son nothing but the best.

I had a Video court and the professional was there and said I could have done other work even when I know I couldn't and plus the City of Los Angeles are the ones that took me off the job. My hearing was 5-31-17 so is it going to take a long time for a answer I filed in 2013 it has been 4 years.

I started my process April 2015, just got a hearing Feb 2017. the judge made a decision April 2017 and was assigned to an underwriter June 28th 2017. as of July 27th I am still waiting to know if I'm approved. I call the sad every week and was told 15 to 20 days to know what the decision is. it's been 21 days. by this point I am so frustrated. seems like when they are playing with someone else's life they don't care how long it takes but I'm sure they would if they were in this situation. it's crazy how long it takes. and what duties does an underwriter have? that it takes so long to verify a judge's decision.
