Previously Denied, Condition Worsened

In my late twenties, I was hit by a car as as pedestrian which left me with several injuries, however due to my education I was denied because of the fact that the evaluators said I could perform a similar job in my field. It has been difficult over the years and I have not been able to keep the same employer for very long each time due to several issues. I have suffered from addiction to pain medication because I was forced to work. I am now 41 and my conditions have worsened immensely. I am unable to stand or sit for long periods of time.I did have internal injuries,but most were lacerations to the liver, which regenerates itself. My main conditions which include lower back pain and depression have hit an all time high. The most disturbing part for me is that I suffered a major head injury which required over 100 stitches, anti-seizure medication, and short term memory loss. It impairs my ability to hold a job, being taunted by supervisors leading to further depression which just continues the cycle. I have been under medical treatment for pain, depression,short term memory loss, pain medication issues, insomnia, etc. I have also been diagnosed with fibromyalgia and survivor's guilt. At my last employer I was asked by a supervisor if I had a learning diability due to the short term memory loss I suffer and pain issues issues have intensified with age. I have tried my best,but with age, my conditions are becoming unbearable. I have seen several physicians that have said they see me as disabled and I continue to be treated which I will probably have to the rest of my life. If I file again, it will be my 3rd time. I am not working now due to the fact that I either cannot perform the work, lift, file,or pass the educational tests in. A timely and satisfactory manner. It is very discouraging and I feel it is time to try again due to the worsening of my conditions. Please advise.

I'm a 60 year old male who's worked as a porter the last 16 years. I've had two torn rotator cuff surgeries and a torn bicep all work related. Right arm was 38% loss of use left arm 32% loss of use at MMI I've also suffer a torn bicep tendon to to my other arm and had two back surgeries the last one for spinal fusion lower lumbar. I'm in constant pain and can not bend stoop or sit, stand or walk for over 2 hours a day. I have a ged and no work skills othe than physical labor. Will I be approved for ssdi based on vocational grid ?

Hi there,
That is really hard to say. Since this isn't listed as a disabling condition, you will need to have your doctor fill out a good RFC for you. You can find one online to download and print off. Many desk jobs do not require any standing or walking, and you do not need to use your shoulders. But since you have no work skills other than labor, I would say that you have a good chance.

I do not believe theres any 3 strike rule...you could always get hit by a car, fall down a hole. You need these doctors you mention to fill out the forms in the 'application' (5 people to vouch for you) & sign them. I only had 1 of my doctors sign an application for me. The rest were family members. You need all current 1)scans, 2) radiologic reports & impressions for all said scans. An overall body assessment by your own doctor or specialists. Go to a neurologist, get assessed by them **if a neurologist will sign the SSDI application that you are truely disabled you're golden. But 2 or more docs ...is good. One your personal MD. & 1 specialist. If you were denied before, get a lawyer, they will tell you what I just did.

I have been suffering with diabetes with levels of 300-600. I have high blood pressure. Diabetic pain in my feet and hands and a fibroid tumor in my uterus. All of which I take meds for, am I a candidate for disability.

Hi DD,
I am sorry to hear that! Diabetes itself is not a disabling condition, but complications are. Tumors can also qualify for disability benefits. If you are experiencing other health issues, like severely high blood pressure, blindness, or other complications of diabetes, you could potentially qualify.

My son-in-law applied and was denied disability. He then appealed and was denied again. Now he has been working with an attorney for almost two years to be awarded disability. Does it normally take this long for a claim to be processed?
