Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Sharee,
If your child's father is applying for SSI rather than SSDI benefits, your children may not be eligible for a check based on his work record as those benefits are not offered with SSI.

Hi Stacie,
I really could not say as we are not experts regarding taxes, you may want to consult your state's regulations regarding custody and tax filing.

Hi Kim,
You may need the father's written permission to obtain that information from the SSA.

Hi Lucy,
It may not affect your child's benefits as they are based on his father's work record.

Hi Cedes,
I really could not say, you may want to contact your local SSA office regarding this as they can give you detailed information that would be specific to your case.

Hi Sherry,
If they are eligible for benefits, then they may be able to receive back pay from the time that your husband was determined to be disabled by the SSA.

Hi there,
If you were disabled before the age of 22, and either of your parents were receiving disability or retirement benefits, you may be eligible for benefits based on their work records.

My husband gets Disability which makes my son eligible also. We are getting a divorce. I will have primary custody, will I get all my sons benefits or will they be split? Also will I get extra since I am the one with primary custody/full time?

Hi Julie,
The SSA will generally assign one parent as the payee ( usually the custodial one), but the amount will most likely stay the same.

Its now been a year and now they day she isn't eligible. Why all this time and got nothing but the run around.she was told since she was adopted by him regardless of age,she would receive his benefits

Hi there,
I'm sorry to hear about that! It would really depend on which program that the father was receiving. If he was receiving SSI benefits, then your daughter may not be eligible.
