Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hello I am 16 and I want to know that if I apply for disability, that even if I am living with my legal guardians, that money will go directly towards me and they will have nothing to do with it. Also I wanted to ask if I could qualify for disability. Basically my situation is that a year ago I was told that I had no peraphrial vision and my neurologist told me that I couldn't work, drive, or do pretty much anything I needed to do until further notice. Since then my vision has gotten much worse and I also need a hearing aid. Will I be able to qualify for disability? Thank you.

Hi Alex,
As a minor the SSA may assign a representative payee for your benefits, which would most likely be your parents, unless you were able to argue that they would be unfit to do so. Additionally, I really could not say if you would qualify as your SSI eligibility for benefits would depend on your parent's income until you become 18. After that, you may be able to qualify based on your own income and financial resources.

Hi Mary,
You may need to obtain another form of insurance for your children, as that may not be offered with auxiliary benefits for dependents.

I have permanent custody of my granddaughter if I get approval at my disability hearing will I be able to draw on her or not

Hi Steve,

Your granddaughter may qualify for disability benefits under these conditions:
The grandchild must be under 18 years old to receive benefits, or under 19 if they are enrolled in high school as a full time student.

To be eligible, the grandchild must completely meet the following qualifications:

The grandchild’s parents are deceased or also disabled
The child had been living with the grandparents before they turned 18 years old
In the year before the grandparent was eligible for SSDI benefits, the child received at least half of his or her financial support from that grandparent
If the child is under 12 months old, he or she must have been living with the grandparent since birth.

Hi,I have a question,I have had full custody of my two kids now for last 4 years,my X wife applied 3 years ago for ssid and was told she got it threw the courts and will be getting back pay for her and the kids she's claiming,So my question is by law us she obligated to give the kids there backpack and check per month? Hi Gary,

If the court said that she and the kids were awarded SSD benefits, then the kids would be entitled to auxiliary benefits and back pay.

I have 2 questions first: I'm on social security disability my son who is 16 lives with his father and gets the social security payments. He now has a job making $1,200 can he still get his payments? Second: when I was 13 I was on SSI for disability I was told at age 15 that if I didn't work I wouldn't get Social Security Disability so I worked when I could. At age 22 I had a job for 2 months. I was told that I couldn't collect from my moms or dads social security when they became 65. Is this right? I mean how can someone be married get a divorce be separated for over 15 years and still get payments after they pass away?

Your son may be able to receive his payments.

I was just approved for ssd! My 3 boys get ssi cause they are disabled! Will my children still get their ssi since I am gonna receive ssd! Also can they draw off my ssd while receiving their own ssi? Also will my ssd income count towards their ssi?

HI Holly,
In some circumstances, you can receive both SSI and SSDI benefits at the same time. This is commonly referred to as “concurrent benefits”. To receive concurrent benefits, you must be approved for SSDI, but receive low monthly payments through the program.

A low monthly SSDI benefit is caused by several factors:

You have worked very little or not at all in the last 10 years
You had very little work history at the time you became disabled
You became disabled at a young age, before building a significant work history
You earned relatively low wages throughout the course of your employment history

I receive SSDI, I just applied for my son to start receiving child benefits under me. How long will it take for him to start receiving this monthly benefit? And regarding monthly payments as well as his child benefits back pay, who exactly will receive the check each month? And whose name will he receive the check? My name, his name, or my ex wife?

It usually takes up to 90 days once approved.

It depends, generally auxiliary benefits may interact any obligations with any child support that you or ex wife may have. For further information regarding your case I would contact the SSA directly: 1-800-772-1213

I have been with my boyfriend for 11 years on and off and we split custody of our son but I am his legal guardian. Anything regarding him legally, doctors, school, etc. I am over. He just keeps him half of the time through the month. He pays me very little child support but has recently got awarded his SSDI and all of his back pay. Well he asked me for mine and my son's social security number and I gave it to him and he was talking to the lady from social security about my sons benefits. Well I was under the impression that my son's benefits would go to his legal guardian which is me because I have to have that to support him from month to month because i only get 300 bucks a month from him for child support and that is hardly anything. My son's father will be receiving his SSDI benefits and back pay and I don't even have a clue if my son is eligible for any of the backpay. But I think that he has done something wrong or lied to the social security lady because he made sure that my son's benefits came in his name. I just don't know much about all of this because he kept me in the dark but I just don't see how he can receive his check and my son's and I only get 300 dollars a month to make it on. Me and my son's father was under the impression for a while now that I was supposed to receive my son's benefits to support us on but now he has made it that he received it and I am just shocked and have no clue what to do. I am hurt because he has kept me in the dark and being sneaky about all of this. I gave him my social security number and my son's thinking that he was helping us and setting it up for me and my son but obviously I got screwed. Does anyone know anything about this. I am receiving very little child support and I am the legal guardian and is there anything I can do to find out anything I can do about this.
