Waiting for decision

Submitted by Anonymous (not verified) on

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

hi i applied for ssdi in 11/14 went to my hearing in 2/17 got denied i have epileptic seizure (gand mal) lose a good job do to my illness. My lawyer said it was a good chance i will get approved. The VE did the local and national she said i cant work. You work your butt off and pay into your social security and you still get denied. You wait all them years and social security push down 2 more steps

I applied for social security disability and just found out they had made a medical decision and the benefit application was being reviewed. What is the wait time at this stage of getting disability.

Hello,

It's tough to say, since every case is different. I would recommend speaking to your disability rights advocate or attorney.

Best of Luck,
Eric

I had appealed my decision to the appeals council and it was sent back to the same ALJ that I saw in 2015, I had a second hearing in January of this year and still haven't heard a word yet they said I should have heard within 90 days..is this a normal amount of time to wait? The last time I called up the office where I had my hearing my lawyer didn't like the idea that I called there and wanted me to leave it up to him to find out what was going on but here I am still waiting? I also was told that something "moved" about April 13 of this year, but when I call up nobody seems to know what that was? I am not sure if they are getting me mixed up with someone else or what but each person I speak to at Social Security tells me something different? if something happened on April 13, wouldn't I have heard back one way or another by now if it is now May?

Hi Lisa,
It may take some time for the SSA to contact you regarding your case, they may take up to 30 days or longer for some types of decisions or processes to go through.

My ssdi processing time has been 800 days so far. My hearing was held 8 months ago, and for the past 4 months the ODAR has been telling me the judge has it and is reviewing it. Any advice? I've been evicted, and out on the streets for months now and I'm beyond desperate. Is there anything I can do? I am starting to feel like I've been singled out and they are purposely prolonging it.

Hi Eric,

I have a Social Security disability attorney who is representing me. He says that there's nothing that can be done, that we just have to wait.

Hello,

I am sorry to hear that. Unfortunately this can be a very long process.

Best Wishes,

I have Chiari 1 Malformation. I applied for disability 8-2014. I had brain surgery 6-2015 and thought it worked. I went back to work 8-2015 and steadily declined in health. Eventually I was forced to resign due to my detioration 9-2016. My hearing was 8-2016. I'm still waiting to hear the final decision. I hear it's been made but still processing. My vocational speaker said there were no jobs in my line of work I could do nationally. Question is; will I be able to get benefits with my Chiari and how do I know how much if I do get awarded?

Hi there,
I really could not say as both answers would depend on your condition, work record, and how much you had contributed to Social Security. However, if a vocational expert testified that your condition makes you unable to work, you may be able to obtain benefits as the SSA makes the benefits determination based on the ability to work with a particular condition.

Okay so my Question is this I had gone to court back in 2016 in may then was told i would have a answer to my case in Nov.. Nov came and went then i was told i would have to come back to court in jan of 2017 after my meet with the judge my lawyer stated that he thinks i won my case ... it has gone past the 3 month mark that i was told i should have a answer my judgment had been waiting to go to a waiter since march of this year .... I just got word today that it just went to a writer today ... we are now in May ... so I wonder how long dose it take the Writer to post it and is there anyway for me to find out before the letter is sent to me ?

Hi there,
you may want to contact your doctors and your attorneys regarding this, they would know what documents they would have.
