Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

I have full custody of my son that receives ssi. His father just recently applied for ssdi and got approved. He is bragging how he is going to get 2200 a month. I put in a claim for our son to collect ssdi benefits off his dad, he is under 18 and in school. His wife just informed me that because i have full custody that his son is not entitled any rights and threatening me with court action and fraud. I have an appt with social security on monday; they are aware of the situation of me having full custody and him having limited visitation in appropriate places. Also am I entitled to child support as well?

Hi Abby,
I could not say what you would be entitled to as far as child support goes as that would vary by state laws and you would still be subject to any agreements you made as part of your divorce, but your son may still be eligible for benefits based off of his father's work record. Additionally, any benefits your child would receive wouldn't affect his father's monthly benefit amount at all.

My son applied and was approved for Disabled adult child, he was deemed disabled in 1996 he did receive SSI up until Nov 2016 he was disabled before he was 22 they only paid back pay until 2008. I appealed and got the letter they say that his father didn't protect him on application what does this mean? and how can I fix this because he lied he knew his son was disabled? Also he knew how to get ahold of us. How can I prove he lied? Thanks for your time!

Hi Suzanne,
We really could not say if there's any way to prove that your child's father lied, however it seems like your child was not listed in the application that his father made at the time of his application for benefits.

My ex-husband recieves 100% disability from the VA for back issues, PTSD and Individual Unemployability. He makes very inconsistent child support payments and flat out refuses to pay for tutoring for our son. I have Primary physical custody and he has every other weekend with the kids. I have just found about VA Apportionments and will be filing for that.
5 years ago, right before we got divorced I remember his DAV rep stating he should file for Social Security Disability, but I have no idea if he did. How would I find out if my children are eligible for benefits without knowing if he recieves benefits? I also have no documentation to provide to SSDI to show he gets 100% disability to even apply for them. Is there anything I can do since he isn't responding when I ask him if he recieves SSDI?

I am very sorry to hear that. He would have to apply for benefits for his children under his own behalf. I would recommend speaking to a SSA representative regarding your matter: 1-800-772-1213.

My son's father and I have been divorced since 2003 and I recently found out that he receives SSD and has been for at least the last 8 to 10 years and that as such my son may be eligible for benefits. If I apply for my son and he is eligible, would he receive back pay and if so for how far back? Also, how long is the process?

Hi Tanya,

He could be eligible for back pay and he could be eligible to qualify under his father's benefits until he is 18. His back pay could go as far back until when he's father first applied. As for how long this could take, I cannot say for sure because each case varies.

If you haven't legally adopted your grandchild then the grandchild could be eligible for benefits from your son in law.

Hi my husband passed away and I want to get survivor benefits for my daughter who is his step daughter. my question is can I still apply if me and her real father have joint custody? If I do get survivor benefits do I share with her real father who has joint custody?

I have two children, age 7&9, and their father gets ssi, I applied for survivors benefits for them when I was pregnant with my son, they told me their father doesn't have any earnings for them to get the benefits, hut if he passed they would, so now that their 7&9, I'm trying to apply again, if they are approved will they be eligible for back pay????
I only wanna know because I talk to another SS employee who said that wasn't true that my kids should have been eligible at that time in 2009..... Just a question

Hi Alicia,
If their father is still living, your children would not be eligible for survivor's benefits based on his work record as those are for children of deceased individuals.

My children's father was awarded SSDI and he claims that the children will get auxiliary benefits and back pay from the day that he was found disabled. He claims that I have to pay him back in full the amount he has paid in child support during that time period, he claims that if I don't, he will be double paying child support payments. Doesn't the Social Security Administration look at this before they issue a check to my children? He is taking me to court over it soon and the children have yet to receive any money from SSDI.
