Backpay involving LTD

Submitted by Anonymous (not verified) on

I have a situation I'm not really sure about. I was denied ssdi but approved for my LTD claim through my employer after sending them proof the ssdi was denied. Due to a 2 year limit on mental health in that policy, the LTD stopped after 2 years. Just before the end of that 2 years, I reapplied for ssdi (new case) because the condition had only worsened. Now we have obtained an attorney and FINALLY after 2 more years have a hearing coming up in a couple weeks. If we win, will we have to pay the LTD company back for that 2 years even though the ssdi case we actually won was at the end of that 2 year period? How will the LTD company know that we even won the 2nd case? Or that we even applied for it for that matter?

Hi there,
You may want to refer to the terms of your LTD policy, as they may have language in the policy itself that makes it your obligation to report this to your LTD insurer. You may be obligated to pay the LTD insurer any back pay specified in your LTD policy, depending on what is in the policy.
