SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi Jrwatters,

Often it takes about 6 months for you to receive back pay after you begin receiving your benefits. You may be able to request expedited back pay.

I know I have sent 2 messages!! But I am desperately needing to know what I can do to get the rest of the backpay!!! I don’t know what else to do we have contacted social security numerous times, my lawyer has tried to help with this!!! My son is really in need of this money to help him pay his bills until he starts his new job and starts drawing a check from them and they pay by weekly!! And he won’t start this job until two weeks and the job he is at right now he isn’t getting to work that much and we are trying to help him out but we are not able to do that much!!!

Hi Penny,

Back Pay will generally come in 3 installments starting 4 months from approval and then 6 month intervals after that. Are you looking to get an advance on the money?

Hi Jose,

I would recommend calling the SSA or making an appointment. They will be able to look at your application and should be able to provide more information. Have you spoken with your attorney? They will receive their payment before you therefore if they have been paid, your money should be coming in shortly.

What is the difference between SSI and SSDI? And how do they determine which one you can get?

Hi There,

SSI and SSDI both have the same medical requirements. The difference is that SSI is a needs-based program, so your income must fall under a specific limit. For SSDI, there is no limit for income, but you need a specific amount of work credits (earned by paying into Social Security). The number of work credits is based on your age. In terms of determining how much you'll receive, it varies on a case by case basis. Things like your medical condition, cost of living where you live, cost of your daily living needs, etc.

If I didn’t have an attorney representing me and still was fully favorable do I still pay someone or do I keep all the money owed to me.
