SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

I was awarded disability in August 2016 have started receiving benefits but as of today haven't gotten by back pay yet and it's been three months. Have contacted my local office and told me it's at the final stages of signing off. My attorney and myself have been contacting Baltimore head office about my back pay. It's just crazy it's my own money.

Hi there,
Your back pay often comes around four months after you begin receiving benefits. So if you just started getting benefits now, your back pay may not come until next year.

Hi there,
If you just got your first check now, I would expect your back pay to arrive in February or March of next year.

Hi there,
You should! The only exception would be if you used an attorney and your attorney has not been paid yet.

Hi there,
That all depends on how long you wait to get approved. If you wait more than 5 months, you will be entitled to some back pay. Some people who wait for years earn $30,000 or more.

I filed in Oct. 2012 for a disability that began in March, 2012. I was denied w/ an attorney at my hearing in one state. I fired my atty & appealed to the appeals council. They kicked it back to another judge quickly and he reheard my case. i then had to move to another state bc of those health conditions worsening.

'That' judge tried to include testimony from experts that weren't at my hearing. I almost missed that when they sent that info to me in the new state. When I finally did find it on the cd (disc) they sent, I objected. Instead of deciding, he sent it for a 3rd hearing before a judge in my new state. I was in & out of the hearing in 10 minutes & they were not at all confrontational like the 2nd & even first judge.

The second judge asked me about small monetary awards I received from 2 car accidents. He asked about the 'money' and not the inuries. I was so tired from driving there & representing myself I didn't think to object right on the spot as I should have.

The third judge approved me by mail about 8 weeks after my hearing. The letter arrived a few weeks ago. I figure I will receive 51 months of so of disability pay according to the award letter's date of onset, 3/2012. I guess I'll be waiting a while for that as a SS rep told me zero interest is paid on those monies. I had no lawyer the rest of the way & the first lawyer signed off on any fees. Hang in there if your'e in the fight. Don't ever give up. I could not start over as my eligibility ran out over that almost 5 years.

Hi Charles,
I don't think you'll receive 51 months if you've restarted your application a couple of times--you could receive up to 12 months of retroactive payments though!

I received my retroactive letter in May 2016 then I received my first monthly payment for SSDI in July 2016 and I have called numerous times and to this day have yet to receive my backpay...Everytime I call they tell me they will send a managers email and I still haven't gotten anything, I know how you feel...Every month is tight, could lose the house at any moment, it's tough. They tell me all retro payments come from the Treasury and my paperwork is in Baltimore...

Hi M C,
That is very odd. You should definitely get your back pay by now. I would continue to call the SSA to try to get through to someone! Fortunately, you will likely not have to wait for much longer.

Hello, I live in Columbia sc .I was denied in August 2014. I hired an attorney .I was then given a hearing date for Octoberr 20,2016. I had only worked 5 years all together in my whole life. I received my fully favorable decision on November19,2016. I then received my backpay on December 4,2016. Major blessing around the holiday .I'm so grateful especially after being told by my doctor that their is no cure for my chronic back pain in my thoracic region and chronic migraines. Stay positive, be sure and keep your appointment ans hire an attorney. God is good.

I started receiving disability last year. I had to wait about 13 months. I didn't know that I could have applied for SSI while I was waiting. Is it too late to apply for that SSI and possibly get backpay for it?
