Denied after Hearing - Re-Apply?

Submitted by Anonymous (not verified) on

I worked with an attorney, but was still denied all the way through and including my hearing. The judge's decision included a reference that she felt I wasn't as bad off as anyone thought with a subtle insinuation that someone was lying. The judge threw out several doctors including those appointed by SS to evaluate me.

I've laid low on re-applying for a while because I'm afraid there will be prejudice against a new case for me based on this judge's ruling. Is such a thing true?

Hi There,
I'm sorry to hear about the judge's decision! I would say that if you need disability benefits, you should keep fighting for them. Don't give up!

Hi There,

It's tough to say, though generally those denied are notified sooner because they only have a certain amount of time to appeal to the decision.

I was denied by ALJ judge also. The judge ignored all medical and professional vocational options. He suggested I was making symptoms worse than they were and also accused me of going to a hospital and demanding narcotics when I went to receive treatment for MS flare up.
That was news to me and my doctors!!!
I was denied less than two weeks after hearing. The decision is being appealed as my lawyer says the judge made incorrect assumptions about my medical care and other misstatements.
From my experience, Social Security will do and say ANYTHING to deny you benefits.
I am now having to go to Appeals Council to attempt to have decision set aside.
