Lost all back pay

Estranged husband was awarded his ssd that he applied for 2 years ago. However, he turned 50 4 days before his hearing and they told him that he would be approved at that time IF he agreed to signing paper stating that disability started at age 50. He lost all back pay and will not receive medicare for 2 years. How is this even legal? He is about to loose electric and be evicted. It seems to me that they take advantage of people in dier need, knowing they can't afford to wait any longer. If he is deemed disabled at that time then odds are pretty good he was disabled when he applied!

I'm sorry to hear about that!
Unfortunately, your husband agreed to waive his back pay due to agreeing that his disability started at age 50 rather then when it actually started. The SSA uses something called the Established Onset Date to determine back pay, and your husband established it as 50 rather than when it started.

How long can a disability case stay in court? In February 2017 it will be five years for me. Is there a time limit?

Hi Catrina,
I'm sorry to hear about that! The average wait time is 17 months, however in some cases the wait time may be longer.
