When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. It's looking like I'll be approved for ssdi. Adj said my disability began (eod?) 12/31/2014. That's 2-1/2 years. Would I receive 12 months retroactive, or 2-1/2 years? Thank you!

You would receive back pay from the day you filled out the application.

I was working while waiting on my approval from SSD it was only 15 hrs. or less a week, and ssd was aware I was working. But guess made so little did not consider it as income. With my work restrictions my boss has really giving me a hard time, about my job saying I'm not moving very fast, always on me ... make a long story short. I have been working since I have been 15 and will be hard to quit, even though I have a hard time now because of my health issues. the stress of my boss on me all the time adds extra stress I do not need. I hardly ever miss anytime, just only work 15 or less a week but gets me out of the house.. I just heard I have been approved for ssd. Is it ok to give a 2 weeks notice do I need to let ssd know since I they do not count it as income anyways.I made $300 or maybe $400 a month if that? I just do not want ssd think I quit as soon as I was approved it is due to the stress from my boss been like that for awhile now.

You may want to contact the SSA regarding any change in your work status, however quitting may not affect the status of your claim or your eligibility for benefits.
My kids was approved for SSDI benefits in February 2017. But they just now was able to reach me. They said I needed to bring in birth certificates and bank account information. I took it today May 8, 2017. When will I receive first payment.

Hi saw alj back in January and approved for sdi in March. SSA has yet to process backpay stating they must first see if also eligible for ssi also. And until then will not release backpay but has also issued my attorney his fees due. Every time I go into the office or call I receive inconsistent information.
Bottom line how long to receive my back pay?

I was just curious if you have student loans but are not in default, but are on a payment plan that goes by your income.The payments are on hold for a yr so have no student loan payments and you get back pay can they take your back pay to pay the balance even if they are not in default ?

You may be able to do so if you're receiving SSDI benefits. You may also want to contact whoever owns your debt, as they may be able to discharge it based on your disability status.
So I have been receiving ssi for 5 years now, while working 3 of 5 years part time. They social security calls me and say I have to apply for ssa. How long will this process tAkes if I'm already getting ssi. I get 735 a month in ssi. How much will my back pay be for worked for 36 month. ? How much will my monthly payments be. And will they take taxes out of my ssa check if I get approved? Will I have to see another state doctor for ssa.

SSDI cases can take varying amounts of time, and there may not be a concrete answer to how much money you would be entitled to as back pay and monthly benefits as those are based on your payroll taxes.

It seems that you are! It does take a bit to start receiving benefits, the SSA generally starts them five months after being awarded benefits.

I won a favorable hearing, after years.. Date of disability onset was Nov 2013, then there was the five month waiting period, so benefits began May 1 2014. I received fully favorable decision in April 2017, after March hearing. I receive work comp, so there is an offset. My benefit is $283 a month (minus 134 medicare), leaving me $149.
So, I thought I would receive $283 per month for the back pay, May 2014 thru April 2017, 35 months. I see a one time lump sum payment of $5028. My math totals $9905, I am confused, why would they not pay for all past months? I read SSDI is only one lump sum, so I don't believe another check is coming. Has anyone had this happen? My work comp amt has always been the same, so that didn't cause any issue. Thanks.

Work comp and SSDI...When I applied for disability, I was receiving work comp, and didn't have a lawyer taking 25 percent. This has recently changed. I submitted the order to the social security lawyer, who is sending on to social security. I was told (by the work comp atty) that with the decrease in the work comp check, I should get more disability, he claims dollar for dollar. It kind of makes sense, and I am not close to the 80 percent cap, by any means. Any opinions on this? Will take a while for social security to process the change, I am worried. Thanks.

That may be the case, if your benefits are income-based, then they would increase the less income you receive from your worker's comp payments.
Hi. I applied for disability July 2012 and will have my hopefilly hearing in late June. Lots of medical records in file, but the Judge refuses to have a residual capacity evaluator present even after the disability appeals overturned denial and told him to redo my case. So July is it's almost 5 years. Is this a good sign or not good because it's so long? If it's favorable, would back pay apply? I have an agressive attorney
