SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Can you be awarded both back pay and retroactive pay .. just curious

Hi Jeff,

Only SSDI recipients are eligible for retroactive benefits. So in theory, yes if you are awarded SSDI you can receive both back pay and retroactive benefits.

Thanks for that.. can you explain the difference.. so my hearing is July 10th, my application date is 6/19/15 and my onset date is 7/5/13.. so say the judge gives me a filly favorable decision.. please explain.. thanks

Hi Jeff,

The SSDI retroactive payments are payments made to disability applicants for the time passed between the onset of the disability to the date that the application was passed.

Back Pay refers to Social Security Disability benefits that you would have received had your claim been approved immediately.

Hi eric.
So your saying for me retroactive pay would be frim 6/19/15 my application date till say august 15th the date judge approved me.. and back pay would be from 7/5/13 to 6/19/15..
Is that correct

You may be able to get retroactive pay up to your onset date. Then you would be eligible for your back pay benefits.

I applied in August 2016 - got Awarded Feb. 2017 - still no back pay yet - from what I am reading takes 4-6 months for back pay ?

I had a hearing for my son in which the odars letter said we will be considering from 2010 up until present of 03 2017. The judges expert seen a long history of paper work and said my son shows marks in many areas. Ans the judge said thank u for my patients but it will take just as long for answer as it did for the hearing for an answer. Its been 2 months. Do my sons approval chances look good

I was approved for disability and received my first monthly check in May, they said I will get back pay so from what I have been reading takes about 5 months so September hopefully I should get it? I signed up for direct deposit so depending on when you get your check each month depending on your birthday date. because of the up coming holiday's coming up at the end of the yr, do they ever deposit a ss check early especially if you have direct deposit set up ? Just curious everything is new to me even I'm so grateful I got approved on the first try, very nervous . and have to change things now on how I pay my bills, just getting use to my new paydays. Just a note* for the ones that are just applying or waiting to be approved, I hope the best to all of you. I know it is stressful and scary I know some still don't get approved if they hire a attorney but if you don't get approved the first time, they will help you in the appeal process. If I to give advice I would tell any body that is thinking about applying get a attorney. Saves a lot of stress and maybe further delays in the long run. Wish all of you luck :)

Hi Melinda,
For SSDI, you would receive any back pay owed to you about four months after you start receiving monthly benefits.

I was questioning weather or not getting a lump sum over a certain amount for ssdi do ssa split it ..and another if i have a child do the child suppose to get money also from when i started the process ..i might me confusing you ..so bare with me

IF you're receiving SSDI benefits, then you would get one lump sum, if you're receiving SSI benefits, then you would have your back pay sent to you in installments. There are benefits available for children if you receive SSDI benefits, you can contact your local SSA office for more details.

Hello I filled in July then reseve in October all they gave me $1,300 dallors no full backpay like they said. I would like to now where the rest of it ? I've been turned down ( 8 time).

ok maybe you guys can clear this up for me little confused, I was approved for ssd thank god, because of the amount my checks, they said I would not get approved for ssi which is fine and I have no problems with that, but the time I applied my lawyer had me apply anyways just incase I did needed it because was not sure if I would get approved for ssd at the time. Now I went on the social security website this morning and said I was approved for ssi and says I will be getting a check for a nice little lump sum, but also says it is only a one time check. I did contact my lawyer and waiting for a reply, but I just want to make sure this is mine, I do not want to write checks on it to pay my bills, or grocery's and then they decided they made a mistake and take it back. I'm so grateful I have been approved for ssd and now may have another check coming my way, nice but little scary too. I have not seen this amount of money in long time actually kind of scary to even spend the money I get from my ssd checks, but also nice too because can actually pay my bills , I really needed this :)

Congrats on getting approved! In certain cases one can receive SSI and SSDI benefits in the same time. You can always call the SSA at 1-800-772-1213 and speak to someone regarding your case. It is always best to double check with them with any questions you are uncertain of.
