SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. I have been awarded my ssdi, also received my first installment on my back pay.. I have recently had to file for "hardship" how long does it take to receive all of my back pay after filling for "hardship" ?

I recently received my approval letter from the Judge they said the onset date was 2012 however I did not file till 2015 but in the approval letter the judge said I probably won't get back pay to 2012 does he have the power to go back further than the application date for my back pay

Hi Capitola,
Generally, back pay goes back around 17 months after you start receiving benefits.

In 2004 I was run over by a car and haven't worked since then. I applied for SSD a few years later, but was denied and I went through all my appeal processes with no luck, even though my attorney said I have a great case. They basically just ignored obvious medical information like it just didn't exist. So I sued them in Federal Appeals court and won. The ruling sent my case back to the ALJ, who the original Judge was now retired. So it took another 2 years to get a hearing date to see another ALJ, then two months later for the hearing. This time they had an independent medical expert testify. After his testimony the ALJ immediately declared that I won my case. A month later I received her decision in the mail saying that my actual onset date in 2004. (My accident date). So it took me 13 years from my accident and 8 years from my application to win my case. A case that was pretty cut and dry according to my attorney. (By the way I had to hire a second attorney just to write my Federal Appeals Court case, a very specialized and important thing according to my first attorney and it appears he was correct. My attorney says that my back pay will go back to a year before my application (minus 5 months), but I've read places here that some back pay can go back to an "Actual Onset Date" set by the Judge, is this true? Either way, both dates are quite some time ago, 13 or 8 years. I see here that back pay is broken up into 3 payments 6 months apart. The first 2 are to be no more then 3 times your monthly SSD payments, the 3rd payment covers the rest, no matter what the amount is. Why they aren't separated into 3 equal payments or not separated at all I don't know. There's more than one thing that SS does that doesn't make sense to me. Believe you me I certainly didn't want things to take so long, I'm lucky I didn't lose my house waiting to get SSD, and it certainly has had a detrimental effect on my credit score, of course my attorney told me I just might start seeing some money sometime around the holidays. If it's the same SSA I have been dealing with all these years it will be after the holidays not before. What's going to happen with my back pay I really don't know, all I can do is pray. Why they have to even break up back pay into payments is a mystery, isn't this money we were supposed to get already?

Hi there,
If you've applied for SSI benefits, they break up the back pay to help ensure that you don't go over the financial resource limits for SSI benefits.

Ssa gave me only 1210 out of 22,150 of my backpay from adult child disable benefits thinking of filing an appeal I don't think that's fair what are my chances of winning

The judge granted my son 5 yrs of back pay only.. No monthly .. 3 weeks ago i went to court he made his decision but hasnt released it to the public .. How long would i have to wait for back pay since theres no monthly involved

I applied for disability 06/12/17..Received a deposit 08/12/17, for 2 months (back pay?) No letter, no update on the web site. I called the office and the gal had no updates either, she said it was impossible to have this deposit and to call my bank.. It says SSA TREAS 310 XXSOC SEC PPD ID: Anyone have this happen?

Hi there Elsa,
It may be a good idea to contact your financial instituition, generally if you're applying for benefits you would not receive any funds without receiving an approval letter first.

My mother passed away in dec. I went to her ssdi meeti g with judge in may, with her attorney present. We was awarded her back pay amd as her only living next of kin, it comes to me, her son. We moved and the lawyers recieved their money, got a call on wed that ssa was looking for us. They said the onky thing that ia holding this up is i needed to fill out a form 1724. Took care of that in a local ss office. Whats next? Should it be paid back quicker as its just sitting in treasury dept?
