SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi there,
if she re-applied, she may only be eligible for back pay from the time of her application.

HI there,
It generally takes about four months from the time you start receiving disability benefits to receive SSDI back pay.

Will it come on the same day of the month that your regular payment comes?

Hi Rob,
It's possible that your date of disability will be moved up to the date you applied--your attorney may have changed your date of disability to give you a higher chance of approval.

Hi Harry,
I could not say for sure, but you may be eligible for back pay from the time that you were determined to be disabled by the SSA.

I receive Survivor's Benefits from my deceased father, and my legal guardian was approved as payee 3-4 months ago but we still haven't received anything. We did have a change of address, but we've contacted our local Social Security office and they are aware. But we still haven't received anything and its been another 3-4 weeks since then. Does anyone know what could possibly be the problem, and what happens to the last 4 months of checks?

Hi Austin,
That's odd--it usually takes around four months to receive checks from the SSA, so you should receive some kind of payment shortly.

Approved 12/8 after 3 denials, appealed with lawyer. Onset is 03/2016 and i am still awaiting award letter with payment details. I also owe both the IRS (1.5k) and child support arrears (35k) and wonder if after my legal fees if I will see any of my back pay. I also am curious if i need to wait for my award letter to enrol my son or inform his mother. Its been 4 years give or take and im glad it is looking up. Veteran, ptsd, SSDI R

I became disabled June of 2011 however did not apply for social security disability until Sept of 2016 because i thought after the many surgeries I needed I would be able to return to work but that is not the case surgery has not helped. I had my hearing Dec 6 2017 in which my stupid incompetent attorney was SO unprepared and without my surgical reports that the ALJ asked for. He was reprimanded by the judge for not having significant documents to my case is there ANYTHING I can do about this attorney? IF I do get approved (which I doubt...because of his incompetence) is there ANYTHING I can do about him getting any of my back pay? Because he does NOT deserve a dime. I did ALL the work myself and he STILL screwed it all up. It will NOT be fair to me if i lose this case and dont get approved because my attorney was a complete incompetent asshole? PLEASE HELP

Hi Vanessa,
I could not really say, processing times for banking institutions may vary and you may want to contact the SSA regarding this.

In a nut shell I applied in June of 2012, denied all the way to the Federal Court to have my case remanded back to a judge who finally after 5 1/2 years approved my claim. That was October 2018. For now since Dec 2017 I've been receiving ssi. Although approved for ssd, it takes them time to process everything. SSI took all my backpay which was $39,299 to pay back cash assistance. Still awaiting numbers for my SSDI. The process has been a nightmare. It'll be 6 years next month. I cant get that time back....SMH
