SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. My 2nd husband passed away early 2017, while waiting on court date for SSDI. 9 months later court ruled in his favor and dated back to mid-2011. I received call 3weeks back from SSA requesting my bank routing info and requesting that I go to local SSA to fill out a form and provide them with a copy of our marriage license. The SSA lady asked when I would be able to do this and I said I would go that day. She ended the call by stating something about them getting the account closed and getting the funds to me. I haven’t heard anything since. Do I need to try calling them?

I just spent an hour on the phone with ssa. I was told that as I was approved for both ssi and ssdi that the backpay for ssi would be deducted from my disability back pay which could leave me with little to nothing. Wtf????? This is in no way fair at all! Does anyone have any tips on how this could possibly be legal???

Hi Lisa,
If you had already received SSI benefits, you would only receive your benefits for SSDI less the benefits you have already received.

I JUST SPENT AN HOUR ON THE PHONE WITH SSA. BECAUSE I WAS APPROVED FOR BOTH SSI AND SSD, I WAS TOLD THAT MY SSI BACK PAY WOULD BE DEDUCTED FROM MY SSD BACK PAY AND THEY CALLED THAT AN "OFFSET" IS THAT EVEN FAIR???? I AM ENTITLED TO BOTH AND I FEEL THEY SHOULD NOT TAKE ANYTHING FROM MY EITHER OF MY BACK PAYS. DOES ANYONE KNOW OR HEARD OF SUCH A THING??? THANKS

Hi Lisa,
If you had qualified for SSDI, you may not be eligible for SSI benefits as the SSA would only give you both if your SSDI benefits would be less than $750 a month.

After almost 4 years and being denied twice I WON my case, how much will I get per month and how much for back pay can I expect? Live in small town of Hanford California but court decesion was made in Fresno California

Congrats on winning your case. I can't say for sure, but generally you will get back pay from the initial date you applied. The SSA may be able to shed some light on that. Best of luck.

go to the Social Security office and tell them you need the money for whatever reason and you can get it all in one lump sum that's what I did

Thanks for sharing! It's important to have a good reason for the lump sum for SSI as they would need proof that it's for dire need.

I applied for SSDI back in January 3,2015, after so many deniel I finally was approved December, 2017, but the judge change the onset date that I became disabled on October 26, 2015, wish is crazy cause due to my disability I haven’t been able to work sene November 2014, I had all kind of crazy symptoms, almost paralyzed due to a dramatic civicle compression that wasn’t discovered until February 2016. Single mom of three kids and my house on Forclosure, in the interview they asked me how did I pay my bills, I told them the truth that I haven’t been able to pay my mortgage and most of the time me and my kids was with out light and water , that my brother would lend me money here and their but it wasn’t a gift, but money I agree to pay back, well they took that information and ran with it and put in the system as income , so my back pay benefits was only $470 instead of the full amount. My brother wrote a letter explaining that it wasn’t a gift and that it was a loan. I need to bring my mortgage up to date, so I won’t lose the house and I need to pay my brother back cause I feel really bad that this has happened, my question is can I appeal this , I’m already appealing the onsete date, but can they do this or is this is something I can appeal. These last three years has been a very bad for my teenager, it has really taken a tole on them , being the kids on the block with the water or lights always disconnected. Thank God I finally got approved, but if someone as the answer to my question, can they count the money I received as a loan that I have to pay back as an income and deducted from my back pay?

I had the small amount put into my checking and taken back out does this mean my checks will start soon? If so what's the wait time now.

they may have made the small deposit to confirm that that is your bank account, I could not say that it is an indication that your checks will start soon.

I received my first check sep.3 20017 and I still have not receivd my back pay I have debt card that my payments go to will my back pay go to my card and will my back pay bee paid on the 3rd of the month or any day.
