Waiting for decision

Submitted by Anonymous (not verified) on

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

HI Irish,
I really could not say as we are not affiliated with the SSA or the federal government and would not have access to information about your application.

Okay so I've had mental issues for at least 20 years although I'm only 33 I had a alj hearing August 15th towards the end of the hearing the alj judge said she believed that I was at one point disabled and wanted to see if I still was and sent me to a consultative exam the exam I asked why I was there was it for a reconsideration after initial I said no the judge said I was disabled and want to see if I was still. I went through my meeting at the end the CEC that we had accomplished everything we set out for I waited 5 days before I called and the doctor had submitted her report I waited four more days and the odar office told me my claim was on the alj desk what's the time frame looking like and do you think appeal could be likely

Hi there, I really cannot comment on the outlook for your case as we are not affiliated with the SSA or the federal government. It appears that the ALJ is in the decision making process, however.

I originally applied for SSDI in March of 2014 and was denied. Found an attorney and reapplied in August 2014. I am 60 years old and have had Type 1 Diabetes for over 50 years. Finally had my ALJ hearing this past November. My attorney and I both feel the hearing went well because of the questions that were asked. Judge asked me how old I was and how long I have been diabetic. Shel briefly touched on my problems but did comment on the 3+ inches of medical records in my file. Judge of coursed asked the Vocational Expert if I would be able to work and he said no. My attorney told me that he got the impression from the way it went down that the Judge was rather upset with the system for having drawn this out to this point. At the end the Judge told us the decision would be to the writers in a couple of weeks. I contacted the ODAR office and have been told that it is with the writers now. What I am really wanting to know is how long can this actually take to go through the writing stage. Is now been 8 weeks since the hearing and 18 months since I started the hearing phase. How often should I call the ODAR office and request an update. Should I let my attorney do that because communication is not his best point.

Hi Wendell,
I really couldn't say how often to call as every case is different and it may take longer or shorter for the judge to have his decision written based on that. However, that does mean that your case is being actively worked on; hang in there!

Hi Michelle,
I really could not comment on your case as I do not have any specific details, but if the judge believes that your employment prospects are limited, you may be able to win your case.

Hi Priscilla,
Every case is different, as as such it may take varying lengths of time for the judge to make their decision.

Hi cole,
I really could not say as we do not have information about disability claimants. Generally, you may need to wait about four months from the time your benefits start to receive the back pay.

Hi there,
You may want to speak with the SSA office nearest to you regarding this, they can give you details about any work you may be able to do.
