Waiting for decision

Submitted by Anonymous (not verified) on

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Is it 45 to 90 business days or just straight day? From the time of your hearing to receive the approval letter.

Hi Mendy,
every case is different, and as such every determination made by the ALJ would take a varying amount of time to complete. I really could not say when you would receive your approval letter if you are approved.

There was no vocational expert at my said hearing. Is that a good sign?

Hello,

Since every case is different, it's hard to definitively say if that a good sign or not.

Best of Luck

I don't understand this whole thing still my boyfriend 39 has degenerative disc & serilk disc disease mild bulge discs that cause nerve impingement to his upper to lower right side, carpal tunnel surgery on both hands, high blood pressure Cancer surgery where he missed 6 weeks of work all in last 8 months, cause work wasn't full time just a temporary part time lost his job. Since September 2014 he hasn't held a job do to pain and ache body along with doctor's visits. Warehouses and unloading trucks all he has done for 25 years two jobs. He can't find a job, he looked into a driving job but quit due to pain and migraines.. Social Security has not helped. This is first time he had to deal with all this. He was denied, now we waiting on an appeal. With lawyers help, social security saying hearing and appeal may take two years we have 3 children losing our rental can't even receive ssi. And IMA doctors I believe they lie about things watch out for them. Why all this mess destroying people life's.

HI Joeselin,

I really can't say because I don't know the specifics of your case. But it is possible to be awarded SSI and then denied SSDI. However, in some cases you can be awarded both.

Best of Luck,
Eric

Hi Joselin,
It can take varying amounts of time for the SSA to write a decision, as every case is different.
