Waiting for decision

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Hello! I just had my hearing last week, and the VE said that I can do sedentary work. My lawyer said that I need my doctor to write a letter stating in so many words that I can't and that I would miss most days if not all.

Question: How effective is that move for the doctor writing a statement? Does it carry much weight?

Hello! I have another question... is it true that if it takes 30 to 45 days for the ALJ to make a decision. does that mean that it wouldn't be in my favor? I think I read somewhere that if it takes a long while, 60 or more days the ruling is in your favor. However, if it is 30 to 45 days it is not.
Would you please clarify?

Hi Sharon,

Every ALJ is different, so there really is no black and white answer for that unfortunately. I will say though, it can take some time to hear back, so don't be discouraged if you are waiting a while to hear back.

I had my court hearing on November,16..2017.. I was told it would take 2-4 months for me to get the judges decision letter. 4 months is up on March 15 the. 2018. I called social security because I keep getting voicemail when I call my attorney, the lady told me on the phone that a decision hasn't been made yet. Contary to what my attorney said. He told me it was made on the 20th of November 2017. So am I getting it in 5 days or not. ?

I had my hearing Dec 1 2017 the Judge said it can take up to 4 months. I called and was told it now with the underwriter. What does that mean. I was also told it can be in the mail any day now.

My friend had her hearing in november they told her it would be 60 to 90 days. Her landlord said if she dosent pay all her back rent she owes by 3/31 she'll be evicted. She called the ssi office 2/15 they said it was with the writer. I was wonder if anyone knows of anyone or place that helps people in this position. Ive been looking and asking around with no luck. I cant afford to help pay to hold off the landlord for her anymore. We live in CA. Thanks

I couldn't complete my ssdi application on line due to connectivity issues so I completed it at the field office , my status has been in the DD's medical process for 3 months , I called DDS office to check In and was told my case was complete just in line for review , my online today says my online application is unsubmitted , a retrieval code led me back to the conditions , dr. And hospital phone numbers addresses etc.. Everything is BLANK ! All this info was given to the field office when I applied in person, what gives ?

I'm honestly not sure. I would contact your local office that you filled out the at and make sure they have everything they need.

Hi John,

SSI is based on very specific financial needs. If you have been working, you can file for SSDI if your condition is considered a disability to the SSA.

How often does the judge agree with medical expert in child disability cases? Medical expert in my son's case found my son functionally equal to listing and wrote major impact on function... is this a good sign?
