Thank you for that, the way some of these explanations were coming over were suggesting a SSDI approval with back-pay involved was capped at 12 months at the most. Which my understanding prior was the way you explained it above. Thank you for verifying. Pay attention people to the information out there, you'll drive yourselves nuts with the wrong information if you're not careful!!

My wife was awarded full ssdi back to 7/2009 her lawyer received his part 2/12/13 and we havent seen her back pay . She did get her 1st monthly ssdi check 4th week in Feb. 2013 and federal taxes were taken out as requested. So what to do?
Jim, I suggest you contact the representative who handles your wife's claim. He or she will be able to let you know what is happening with your wife's back pay. Good luck!
My husband was fully awarded SSDI on 1/25/2013 and received his award letter on 2/5/13. We applied immediately for SSI for our 2 small children on 2/14/13 and received their back pay for 2 years just 2 days after the phone application process, which was directly deposited into our checking account on a Saturday morning, however, we have yet to receive his actual SSDI back pay for him, which is somewhere around $35K. The attorneys were paid 4 weeks ago, and we've called SSA several times, only to get different answers each time. One person told us it can take 90 days from the day he was awarded. Another rep told us it can take 60 days from the date of the award letter. We were told in another conversation with SSA that it had not been processed because they had to ensure he hadn't filed for SSI for himself or any State benefits while he was in pending status. The rep said everything was clear with him and it could be processed and that it was a good thin he called because it was just "sitting there" so to speak. After reading horror stories online, I've had my husband call and stay on them because as I said, there have been many answers given over the past couple of months and today we were told that it should process 45 days after the award letter was issued, which was 2/5/13. The rep also said that today is only 43 days and that if we don't have anything by Friday, then to call on Monday and she can send a message to the processing center but if she sends a message too soon, it could cause a delay. So confused as to what to believe....hate to stop calling as we found out already it was just sitting there and it wouldn't have been "pushed forward" had we not called. We have things we need to take care of as well as a nice get away because of all we have endured the past 3 years with his disability and the claim process, appeal and so forth...I paid for our vacation when I got our income tax, assuming we'd have the back pay for our spending money by now...vacation is in 32 days. Yikes!!! Cross your fingers for us and say a prayer as well, I'm biting my nails....and SSA is a pain to deal with already!
My husband got his award letter an was told how much he would be getting each month an how much back pay he he would get . The lawyer has been played an my husband is still waiting. He was also told 2 different things .that his back pay will be let go in about 60days .Today he was told they were still calculating it we are going to be homeless by the end of the month is there anything he can do to get his back pay sooner
He can only get his back pay sooner if he has a medical emergency.
You can also get your back pay early for financial hardships, such as not bend able to make your mortgage payment. SSI can release 2199 when you are approved for SSI along with your monthly benefits, then 6 months later another 2199, and then 6 months later the remainder of your SSI back pay. However, if you have work credits and are approved for SSDI once you start receiving your monthly SSDI checks they will release all remaining back pay for SSI minus your attorney's portion of applicable. That is only if you will no longer get SSI- and an example of that would be if your monthly SSDI amount is $400- SSI would step in and pay $333 to equal $733 which is the max amount of SSI per month. That's the o my way you will draw from both programs.

Diane you can take your bills like electric and mortgage or rent and go the the nearest soc sec office with them and request they realease some of your backpay to pay them. They can do this and you will get it in a matter of days. Hopefully this helped you out
I was told u only can get 12 months back pay, that's it!! Now I'm confused because everybody is acting like they get big payouts still. I hope u all r correct. I go before alj on 4/12/17. My onset is 4/29/16, I applied 6/2016( my application ). My lawyer applied for both. So will I get ssi back pay for those 5 months?? I will get ssdi pmts around 1400 a month so I know I can't draw ssi in addition, just can I get ssi for the 5month period. Cause I gualify financially for those months, just wondering❤️
I really could not say if you would get SSI benefits at the same time, however if you have demonstrated need for them ( as in you have bills, eviction notices, ect) and you aren't over the financial resource limit, you may be able to be awarded SSI.
Nellie, Unfortunately there is no clear answer to this question. Many factors affect how long it takes for an individual to receive back pay. I suggest that you continue to regularly check in with the SSA. I'm sorry that I couldn't be more helpful! Best of luck.
This sounds like me!! I applied 3 years ago. Court date was Sept 2014. Judgment letter came Dec 2014. (I won but the onset date was shaved down to 2 years ago - ?)Jan 2015 Got a letter stating what the back pay was and when to expect 1st payment - March 15. No reference to my daughter was included. Within a week had an appt at SS, had her added and her backpay was in the bank. Second check was DD today but am hearing back pay/lump could take up to 90 days AFTER the first payment (which was March 2015). If we didn&#039;t have family that has been willing to loan us money against the lump, we&#039;d have lost our home, our car, everything. 3 years is a long time with only one very modest income and three people to feed/shelter. I thank God and us taxpayers for the assistance but the system is horrible. What do the mentally ill, elders, disabled with no support do?
I had accident 4/20/13, applied 5/22/13; got denied twice, had court hearing 2/23/15. There was a delay getting the last part of my medical record to turn in - turned in last part of med record 4/13/15. 4/30/15 (Thursday), got a call from Judge&#039;s assistance telling I got a fully favorable decision. May 1st, 2015 (Friday), I went down to the hearing office to pick up my copy of ruling. Sunday morning (5/03/15), I checked my account at SSA, saw a note saying I got back pay deposit on 5/04/15 (Monday). It&#039;s a big check 19 months of back pay. I panic because I realized that the account the money was supposed to come in was an old closed account at Wells Fargo. Monday morning, as soon as the bank open, I brought in the printout proving back pay to the bank. I didn&#039;t have any account with Wells Fargo anymore. Talked to the bank, the bank opened a new account for me with 0 money. Tuesday morning, the money show up with the bank for my old account. The banker called to have the money rerouted. All done and good!! I&#039;m happy.
My brother was awarded dado we also have a lawyer I am his poa n also ass wanted me to b my brothrs payee all paperwork submitted we r going to b come homeless at end of this month we have been over to ssa Office 3xs in last week my brothr collapsed this weekend from dehydration n depletion as we do not have money for food when he was released from hospital I took him directly to ssa to try to find out when we will get his backpay as we need this money to move they would not take his hospital paperwork or our failure to pay rent they want us to come back on thursdy to see a supervisor he was old for benefits on 7/31/2013 n was told he would see his backpay within 60 days n his 1st check on 10/9/2013 my brother has health issues heart, tbi n depression where do i go for help our lawyer can not reach anyone either they say that everything is in order n there is a prioroty on his case but not to keep asking for help b cause it will move u back why would that b the case?
I was awarded a full approval for SSDI and SSI . I was told by 3 different people 1. My attorney 2. the lady that handles the money part with my attorney that makes sure I get all my moneis awarded to me 3. The SSI rep. That total with SSDI and SSI combined a month I would receive $866 a month. My 1st payment was last month. I got $694 SSDI and $866 SSI so that confused me alot. My award letters say that I would get $24,000 back pay for SSDI and 17,000 for back pay SSI. (SSI would be be paid in 3 installments 6 months a part. I received a ONE TIME payment of $2599 (SSI) and then 2 weeks latyer I received a $1thousand something ONE Time payment from????? I called the lady in charge of the monies to day to ask about what that payment was and she told me that was my lump sum!!!!! I would get another payment in march of 2,599 and then 12,000 (the remainder ) next sept. I told her those numbers did not add up and where is the BIG one lump sum from SSDI. She said they deducted the 17000 from the 24000 and then 6000 for the attorney fees and then the 2 one time payments and thats whats remaining.... HUH??? Im no math major but Im sooo confused... I was told that I would be getting 2 separate paybacks.. SSDI and SSI why would they deduct from each other and be combined and then both be in 3 installments? I was told the BIG LUMP Sum would be from SSDI and the the smaller would be from SSI and that one would be in the 3 installments. Seems no one can help explain any of this to me since they all said something different... can anyone help me straighten this mess out?
Jena on question #27... I am in the Same Situation..Got letter stating amounts of $ for backpay for SSDI AND SSI. My lawyer has been paid his $6,000. I have received my 1st BACKPAY check from SSI for approx $2,000 (and was told same info on SSI Back pay in 3 installments AND SSD IN ONE LUMP SUM) I&#039;m worried after reading your story! Same thing happened... At first I was told SSI comes in 3 installments... SSDI in one lump. After I got 1st SSI back check... I called them...THE STORY CHANGED. SSD MAIN OFFICE in Washington told me that THE ENTIRE AMOUNT OF SSI BACKPAY WAS GOING TO BE DEDUCTED FROM MY LARGE LUMP SSD BACKPAY!! I&#039;m SOOO confused. My Biggest QUESTION to everyone here.. i just had my hearing with the judge on my disabilty on 10.29.13. my lawyer said i was approved because the vocational personal said there wwaas no job i could do because of my disabilities. i dated my disability beginning 1/1/10 the judge said there was a sticky note on my folder from my 1st denial that person felt my disability began 9/09...that confused me anyways my lawyer informed me i would receive backpay from 9/09 till present..so what 4+ yrs? ok why is some saying ssdi only backpays 12mths? also my kids will draw off of me my 14 yr old recieves ssi and i have a 4mth old..howe do or will they determine their benefits or backpay im sorry if im not making any sense i know what i want to ask not sure im using right words..also how long does it take to get your b/pay im sure it varies state to state im in ar...also my lawyer did mention 6m waiting period and stated i would recieve ssi in the meantime..if any one can help me understand i would relly appreciate it...also can student loans garnish ssdi??to all you with same situations as i hope thing hurry up for you i totally relate to how u are feeliin..again thank you and i hope one of you wonderful ppl can give me sum clarification...

ssdi my lawyer said i would will get a backpay from ssi for 9/09 thru 2/10 then ssdi would pay 2/10 to present. i had enuff credits..im also confused bout the ins part..i just recived letter said i will start get traditional medicaid start in jan. thanku
Hi Kelli, I'm not sure what your specific question is. If your child receives SSI, he or she may not be eligible to receive dependent benefits. I suggest that you call the SSA to ask about whether or not your children are eligible. Also, depending on your specific circumstances, you may be eligible for student loan forgiveness or cancellation due to your disability. Be sure to ask your attorney about this.
I was receiving spouse SSD benefits and now I am approved (9/24) to receive my own disability benefits. My spouse SSD benefits were suspended but now I'm not receiving anything b/c my SSD benefits haven't started and will not until 12/18. SSA has taken 3mo of Medicare premiums already yet I have nothing but an award letter saying I receive my SSD benefits, which I do not. I was told I wouldn't receive back pay until 01/2014 maybe even as late as 02/2014. Is this correct for me not to be receiving anything at all?
I had a hearing on JULY 15 and it was in my favor.and on August 16 I received my reward letter and waiting on the other letter to see how much is my back pay.it normally takes 60 to 90 days but it took me 1 month for my reward letter to come in.hope this help you a lil bit.
im receivivng ssi disability my car just recently broke down. this is my transportation to and from doctors I don't have money to fix it at this time. ill be getting my six month back pay in march I cant wait that long I contacted social security explained my situation to see if I can receive back pay earl.as I cant catch the bus cause I cant handle sitting on the seats I have a doctors note stating of that I was told to have car be seen by license person to find out cost of repair.i have a problem I cant move my car due to the extent of my car I could cause a major accident trying to get it looked at from a mechanic shop.what can I do?
My mom recently got approved for disability. She worked for a large retail company for 15 years. When she got hurt she went on short term disability and then long term disability. The advocate company that is handling her long term disability was also helping her through the process to try and get approved for disability. Now that she has been approved they are telling her that all of her back pay she received plus the two disability checks she has received since is owed to them by law. Can anybody tell me if this is true? My mom paid into the company for 15 years to have the short and long term disability available to her. Now they are telling her that she has to give them everything social security has sent her. How is that even right and how can they get away with it? Can anybody shed some light on this? How is it right for someone to strugle to get approved for disability and then have to turn around and hand every dime over to a company they had already been paying into fo the lasr 15 years? They are planning to contact a laywer to look further into it, but if anybody knows anything about this or has any helpful info it would be greatly appreciated.
I went through the same thing..when I got my back pay I had to give every dime to Long Term..which I paid into my company for 17 years..I did not understand this at all.
I'm sorry to hear that! Some long term disability insurance plans may include provisions for them to reclaim their costs based on your disability back pay, it's always best to know if that's stipulated in your long term disability insurance policy.
Hi, Jennifer. Typically disability attorneys and advocates have claimants sign a fee agreement up front. This agreement allows the SSA to pay the advocate in the event of an approval. Typically the fee is 25% of back pay, up to $6,000. Do you or your mother remember signing a fee agreement? And, is the advocate asking you directly for money, or going through the SSA?
I was hurt on the job, (usps) n have been receiving owcp since may 2008, applied for ssdi in 2011, I waited cause I thought I was goin to return to work but they fired me b4 I even had my surgery on lower back, which has left me with major nerve damage, was approved by alj nov.2013, got letter frm alj fully favorable, and onset date of injury by alj may 2008 according to sections 216 (I) and section 223 (d), whatever that is, but ssa did go by onset date alj allowed me instead they gsve me an eod, establish onset date, can this b appealed, and they say im only getting a one time payment which isnt enough to have waisted time on, I get 66 3rd % frm owcp, (feca) and I knw im entiltled to 80% but ssa say my monthly is $0, the alj even said I had a very strong work history for past 15 years, im not understanding this at all.i was receiving 75% from owcp when my son was in school up until age 23 which I only received for bout 10mnths, and that increased my owcp check by about $240.00 per month n now im intitled to 80%, wit the 13% comming from my social security, but they sayin im intitled to $0, sumone please help me understand what are they doing at ssa.
hi there. i was just told that i was approved for ssdi for ptsd. since its a wounded warrior case and its expedited, does this mean i will see my back pay soon? i was told that i was approved on feb 27 2014. i have not received the award letter yet but i called the 800 number and they read me my approval letter. anywho when should i start seen my back pay and check?? thanks
Youll neer see it. Just like me. Ive been waiting since 2007. I was told that i had too many rescourses that i didnt deserve my back pay of 32,000. I was going through a divorce at the same time and got nothing out of the Divorce of 11 yrs. So I&#039;m not sure how they figured I had so many resources since I was only getting state assistance of $331. a month. and food stamps.
That is not necessarily true. First of all from one vet to another, thank you for your service to our country. I can relate with how convoluted the information supplied by the Gov't. Both with the VA and the SSA. I receive SSDI for my PTSD. It is service connected but I had such an overwhelming amount of documentation of how totally debilitating it had become for me. I had been hospitalized several times for psychiatric issues including two suicide attempts. The fact is that it has completely stripped me of my ability to function in society much less hold a job. In my case I worked very hard during my entire enlistment and continued to do so almost the very day I was discharged. I had some very VERY difficult manifestations of my PTSD which I managed to "white knuckle" my way through for a very long time. Then I experienced a very traumatic suicide of my step-daughter and all the fears I struggled with, the nightmares, etc completely destroyed what little hold I had left on my sanity. I share this all with you because I want you to know that you are not alone in having to not only accept that you are not able to work but then to face the wall of gov't double talk. Keep heart!
I was supposed to have had a bunion removed and when I woke from surgery I had a metal plate and 8 screws in my left foot, I also have sciatica a herniated disc, arthritis in my spine so I get the nerve root blocks, and I received short term which turned into long term disability because I can&#039;t work my job of manufacting. I have been denied 3 times and now I&#039;ve been waiting on a hearing for 8 months. What can I do to push this along? My job hired a advocate for me but it seems as though they serve no purpose.
Hi Denese, I'm sorry to hear about everything you are going through. Unfortunately the Social Security Disability application process can take a very long time. The best thing you can do is to remain organized and persistent. Respond to the SSA's requests in a timely manner and check in on your case periodically. I hope things speed up for you!
I can not believe there is no one we can go see, phone a representative directly or email regarding my back pay. I was told in Sept 2013 that I was approved. They told me what my monthly deposit would be and the amount of my pay back. I have been calling the main office and then my local social security disability, every other week since 9/2013. I was told to call today 2/2014 if pmt wasn't depoited. Cindy at el cajon ca office told me she wouldn't beable to call me back today until 3:30pm. When I hadn&#039;t received her call back, I called the El Cajon office closes at 3:00 PM. She knew that and had no intention to call me back. We owe so many bills; living with my mom since 11/2012; something has to be done.

I was approved for SSDI and SSi, I received a letter from SSA stating that my first SSDI payment would be on 3/12/14 and gave the amount. When I logged online through the SSA website, it showed a large lump sum payment on 3/3/14 that was deposited into my bank account, I am assuming it was the SSI back pay owed to me, It was a surprise to me since I never received any information as to when those payments would begin. I just logged into the SSA website again and now it is showing that there was a payment for SSDI on 3/4/14 - I did not receive it, and another payment for SSI on 3/5/14. I have been patient with this process for so long, but this is just so confusing. I am assuming that they are going to use the 14th of the month for the first SSDI payment, being that was the original date it was supposed to be deposited, and then since I have now been approved for SSI as well, starting next month it will change to the beginning of the month. And the SSI back pay also included my first SSI payment. Is this anywhere near how this works, I have contacted my Advocate, but haven&#039;t received a response from her yet, I just wish they were better at communicating what is going on with everything, I am sure there are many people like me, just waiting in limbo, trying hard to understand what&#039;s going on. I thank you for any advice or help with this.

My husband came home sick from work on 12/09/13 and never returned to work again as he was diagnosed with metastatic adenocarcinoma lung cancer stage four on 12/242013. He was told the had less than six months to live. He applied for social security disability on January 21, 2014. His claim was approved but there was a five month waiting period from the 12/09/13 date. On 02/18/14 I was urged by a social worker in the cancer center to take her business card and go to the social security office and request a fast-track on his claim, tell SSA to call the social worker for his most recent medical records to back up my request because he was now given only two weeks to live. I went to the SSA office with that information. The intake worker wrote some things on a paper, did some things on the computer and then told me that it was okay. She repeated that three times, then she gave me this disclaimer - my husband was found to be disabled as of 12/09/13 and his application for SSD was approved but that he must wait until June 2014 to receive his disability payments. My husband died on 02/25/14. I copied this next statement directly from the SSA site www.ssa.gov/compassionateallowances/: &quot;Social Security has an obligation to provide benefits quickly to applicants whose medical conditions are so serious that their conditions obviously meet disability standards&quot; Why wasn&#039;t he considered for a compassionate allowance?
i filed for disability since december 2010, my case was denied, i applied and it was denied again, then my lawyer appeal that decision to the appeal council, after 18months, it was remanded back to the alj, i had to do another medical, send it recent medical, then got a hearing date, my hearing was in september 2013. After almost six months waiting on a decision, i just got a fully favorable, going back from the first day of disability which was in 2009. Thank god, now i went to my local office for them to expedite my payment, because of the hardship i am going through. Waiting now for my award letter and back pay... So to all of you never give up....
Hi, Angie. Im happy for you. I am waiting decision from ALJ judge. I have been waiting for approval for 3 years. When I filed for SSD they had already calculated my 12 months backpay. That was in 2012. Do you know if I will receive backpay for my 3 yr. extended wait?
My brother was approved for ssdi Feb. 18, 2014, and was sent a letter stating because he had already started regular social security, he could continue that or pay back benefits and go on ssdi. He elected to pay back benefits and go on ssdi. He sent a cashiers check Feb. 26, and so far ss administration does not show anything received, and he cannot reissue a check for 90 days. Should he worry about the check not being cashed yet, and not showing up under his id#, or should he just be patient and wait for them to administrate it. He has gone to the local ss department, but they are only able to look online, and not wanting to call ss administration for fear that it may delay his claim further. He has no other income sources, so I was wondering if this is normal.
I am a 70% sc disabled vet and I applied and the end on on Dec, 2014 I just checked mySSa website and it said i was approved and mailed back pay on mar 27 but I haven&#039;t&#039; got it yet. I&#039;m not sure what I got approved for. I didn&#039;t use a lawyer or anything. I applied online and didnt even finish. When I got to part about List last 15 jobs, I just put questions marks of everything that was bs and I told them in remarks section for them just to look at my IRS file. Maybe its from PTSD and/or the seizues but hag in there guys. The VA process is definately worse. It took me 8 years to get just 70%. Rock On.
My 10 year old daughter has sickle cell and has been getting SSI since about the age of one. Her dad died in January, I applied for survivor benefits and found out that his other children have been getting money from his disability since August 2010. I received a letter saying that they would be withholding that money until they calculate how much is owed to her. Yesterday I got a letter saying that they only withheld about 4500 and will not be giving it to her because she was receiving Ssi. They said that they over paid her 4500 so she will receive NO BACK PAY. But she will get $369 per month SSDI.I find d it hard to believe that in 4 years she was only owed 4500. What do I need to do? I&#039;m definitely going to appeal. Do I need a lawyer?
Your daughter can't collect ski disability and ssdi disability. The other kids probably get because they're not disabled just dependents. I know because I'm on ssdi and my son gets sick and I don't get anything from ssdi for him only my daughter. There called auxiliary benefits.
My husband was approved for disability at the end of March 2014. He received his backpay and his monthly benefits have started. He did an application for our minor children. How long (on average) will it take for their benefits to commence and (ballpark) when should they expect to receive their backpay? We turned in all required originals in person to the SSA rep who took their application approximately three weeks ago. SSA was holding up his backpay (although he did not qualify for SSI nor did he have an attorney) until we contacted our Congressman. We don&#039;t want to do that yet for our dependants&#039; backpay or monthly benefit because we wanted to give them a reasonable turnaround time. Any input would be appreciated! Thank you.
