If the Social Security office is working on my SSDI to calculate how much I should get a month how long would it take for me to receive my check after that

I'm not getting any checks my wife's Dad passed away last year but he had gotten approved for back pay..so this money belong to my wife and brother.. it's supposed to be split between them this should be a very simple case with no issues but maybe I have read to many horror stories on here about how ssi and ssdi work seems to me the waiting period is long so you'll die and they won't have to pay anything. ..

Your daughter's back pay should show up around four months after her monthly benefits start, since she's got two monthly payments, I would say it the first installment would show up around two months from now.
So my question is can an attorney get more than 6,000?? They said they withheld 21,000 for attorney fee but would pay us what he doesn't get.does this mean he can get more than 6,000?? Thanks for all information...
No, an attorney can definitely not get paid more than $6,000. That attorney fee is outrageous and I believe that may be your full back pay, not just what the attorney is receiving.
Okay here's my question I was awarded fully favorable by Social Security judge to receive my disability my papers say but the claimants date last insured was June 30th 2013 it goes on to say that the claimant has not engage in substantial gainful activities since February 1st 2013, alleged onset date all set date, my first date of Ensure for disability was October 2011 and have not worked since then which up until this date which was June 30th 2013 per my lawyer says they owe me back pay call Social Security Administration office and it shows in the system that they do only money but has not released it. Now I understand that the lawyer has to get paid but my lawyer is paid back in December of this year 2016 and I have not yet received an award letter stating just how much I am to get even though it shows in the Social Security Administration system and amount of money that is due to me. Today I called the 1-800 number for Social Security disability because before I was talking to my local office which I happen to go inside to talk with someone and they could not understand why the money was not put into my account they checked every area and they said everything was clear I didn't owe anything to anyone and they did not understand what was the hold up since my lawyer was already paid back in the month of December going back to the phone call of the 1-800 number to the Social Security Administration I called them today which is April 4th 2016 and the lady did a little more investigation looking into her system and it shows that the lawyer was paid back in December but there was also a hole put on the money that was supposed to be released to me and then on top of that it's said that is up for review. My question is if there's nothing at all why would it be up for review or why would they have a hold on it for what reason. I'm trying to figure out am I due any money since I can't get a sensible answer from the 800 number nor my local social security office what is going on I do understand that it takes a few months but my lawyer was paid back in December I've been paid and now it's going into 90 days three months down the road so is there anyone that can help me with this issue, I've been worrying if they're going to give me the money or not I understand it's a quite a bit butt why would they have to go and review it again or even had it on hold in the very beginning why was not my payment lump sum payment released to me can anyone give me any idea thanks I have so many bills to catch up I really need this money asap, not that they care but my credit is in jeopardy waiting on this payment.
The SSA usually starts payments about five months after the date of your award, so if it has not been five months yet, you may still have some time to go before payment starts.

So I found out if you go to a federal court they can get more than 6,000 plz for give me for asking to many questions but I was thrown in to this situation and I have a problem with not knowing the situation I'm in ( makes me wanna know) anyway 2 weeks a go my wife's Brother received a letter stating all the back pay amount and from the dates which is 85,000 and the attorney situation has now been closed do you know how long it will be now or the next process? Bryan we do not get benefits we are a claimant of a deceased parent...we filled out the 1724 paperwork and they told us 30 to 60 day and we are over the 60 day mark! The attorney received paperwork showing the back pay and it was sent to my wife's Brother 2 weeks ago, state the years he would be paid and the amount and we also called and as of March 28th the attorneys part was closed out...So I get the fact it takes up to 4 months for back pay after you receive first benefit check is it the same amount of time if you get no benefit check and no ssi or workers comp?
If you're not receiving benefits now, currently, then you would have to wait for your benefits to be approved to receive back pay.
Well today my wife called SSA so the lady sent a message to the payment center while she was on the phone to release the underpayment so I'm not sure what good that will do but just wanted everyone to know the status...This is the most messed up system I've ever seen...

Yes, you can get your back pay while also getting regular monthly SSI payments.
Ok so I gotta know is their a difference between a district Judge and a federal judge?? Apparently the attorney can get more money if the case went to a federal court but on SSA computer it says district Judge any information will be greatly appreciated...
I think your attorney may be talking about the Federal District Court stage of your appeal. I'm not sure what the difference between a Federal and District judge is.
I don't have much knowledge about the attorney process but they took 21,000 from 85,000 back pay that's what the letter to the attorney said so if he wanted to charge a fees he would be paid out of that. I am not sure what he got but they closed that process very quickly I wouldn't think he would get that much money..Anyway it seems the last date they worked on it is March 28th not sure what's going on now..
That's very strange. Attorneys who work through the SSA typically only take no more than $6,000 of your back pay. Did you work with an advocate who was not affiliated with the SSA? And have you received your back pay yet?
We have not received back pay yet first they said 30 to 60 days and now it has changed to within 90 days I am about to speak to Oklahoma representatives because this should be done...

So it's been 14 days since the attorney process has been closed out...You would think they would have a new entry or something in the computer..wouldn't you?? Any way I just wanted to update everyone that if you call the national line you will get different answers to your question...Arkansas is really bad about information I would avoid them at all costs they will just make you depressed...
We contacted the state representative this morning and sent in the paperwork to our surprise the lady that is going to work our case called us very quickly hopefully we get the same response concerning SSA..
So today we called SSA and he told me they are still working on the attorney part ugh!!!. I said the last 3 people seen it was closed out..He then said I don't see how because it says it's pending..Hummm , How can they be so dysfunctional...so we have talked to the representative that is looking into our case she sent an inquiry Monday and it is now wensday nothing new yet she said sometimes it takes 2 days to 2 weeks...I guess with all the horror stories I just don't want to be a static so I will call every person with power until it's resolved in a timely manner because in the end your don't matter to anybody

I received letter in Dec 2015 to see a judge. I haven't had a paycheck since oct 2013 I applied in Nov 2013 with an atty. It is very hard to live off one salary when half of it is your rent. Do you know how long it takes for an hearing with a judge.
The average wait time for a hearing is 15.5 months. Your wait time may vary.

Backpay is usually paid six months apart, so it should come sometime this month. I would contact the SSA if it does not arrive during that time.
Called SSA today they said they can see it's being worked on the last day is the 7th it seems they are doing something on it once a week I'm hopeful it's close tired of waiting...

You should see your next check in the coming month, if you do not you should reach out to the SSA, there may be a problem with your back pay.

SSDI benefits automatically convert to retirement benefits, so it is not possible to receive all three types of Social Security Benefits. Back pay usually comes about four months after your checks start coming in.
So they worked on the back pay March 28th then nothing until April 7th and now we are at April 18th anybody know why they work on it so far apart??
I just wanted to edit my post but I guess I can't so the back pay has been worked on constantly since January 28th and what I mean by this is several entries every week up to March 28th and it has slowed way down still waiting on the congress to Contact me from when they acquired about this case which was last Monday...
Update...So today the ssa were a bunch of non helping idiots so my wife had her brother call them because she kept getting the runaround anyway they told him the attorney was paid on the 18th so while she was on the phone an unknown number was calling so she switched over and it was the payment center not the ssa office the actual person working on the back pay so they called to verify mailing address and account numbers for the lumpsum..so is this normal for them to contact us? He said it should be done possibly this week or next week...
I was reading through your posts and all that your attorney I think and 21000 from you and yours went all the way up to the federal so my attorney is trying to take like over 30,000 I was wondering if you were contacted before the attorney was paid because my understanding is that you're supposed to be contacted to approve it my attorney didn't do his job at all that's why it's taken almost 8 years for me to get my approval by chance would you know who I need to contact to be able to appeal his request to take that much from me
Disability attorneys are only able to take 25% or up to $6,000 of back pay for their services. Are you sure that your attorney was not talking about the total amount that you are owed?
Normally they are only allowed to take 6000 or 25% whichever is lower I was informed by my attorney that if a case takes a lot longer than the norm and goes beyond the alj hearing as mine did then the attorney can take up to 25% I think is b.s. bcz basically what it amounts to is that he is getting paid way more for not doing his job I did read that I can appeal the amount if I don't agree once social security has decided how much he gets I have 30 days once I'm notified I really wish I could find out how to contact the payment processing center in California so that I can tell them what he did and didn't do honestly there are quite a few people who think that I could file a suit against him for not doing anything to a satisfactory level at my alj hearing he didn't say a one single word because of his lack of effort I have been forced to live in severe poverty with two children for the last 7 years mitt angers me to think that he can and probably will get 25% of my back pay I am owed over a hundred thousand in back pay that's just for the ssdi portion there was another person on here that 18 thousand taken out for their attorney I have no problem with the second attorney being paid but not the first guy it's so frustrating because not many people end up fighting for as long as I had to so no one really knows the answers
Your former lawyer may be taking out of pocket expenses into account as well, those expenses are not affected by the $6,000 dollar cap. You can also contact the SSA payment center here:

Lyndy the attorney can ask for whatever he wants up to 25% it does not mean he will get it but it will be over 6,000 and no they won't ask you if you agree with the attorney fee he will get what the ssa wants to give him/her after you have been paid then you can appeal his money after you get your letter you have 60 days to appeal what they gave him/her..
