Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Yes she can! You should stop by your local SSA office to fill out some paperwork to arrange that. You could also receive payments yourself until your daughter turns 16.

Hi, ok so my daughter receives survivor benefits from her deceased stepfather, recently my parents have gained temporary custody of my daughter. Are they allowed to collect this check? I've read some where they would have to adopt her in order for them to get control of this check and her natural father still pays child support. Are they entitled to all this income and wanting myself to pay child support now as well. Can they do this legally? Also I have applied for disability (waiting on hearing) so does this deem me as disabled so they can retain this income? Will I have to pay this child support if I have a 0 income?

Hi Betty,
They may be able to do this legally, and they would not need to adopt her. You do not need to adopt someone to be a legal guardian. If you get benefits, they will not be able to take them, but a Child Services court could potentially order you to pay some of your disability benefits to your child.

If my parents obtain legal custody of my daughter, whom draws survivor benefits and I am the payee can my parents get this check?

Hi there,
Your parents may be able to get that check, especially if they become the legal guardians. They would need to stop by their local SSA office to arrange this.

Hi,my freind daughter father receive social security benefit for many years....she just applied for her daughter to receive her benefit.....is her daughter eligible for back check..?,her daughter is fifteen and is a disabled child.

Hi there,
the child may be eligible for back pay if the claim is based off of her parent's work record rather than her own disability.

My ex husband my daughters farther is receiving disability benefits they said she was awarded to have money but at this time there was no money to give to her I don't understand what's going on that all monies was going to him how do I get that change so she can get her benefits

My disabled son turned 18 and his grandparents are filing for guardianship for is SSA will I as the father still have to pay child support because he is in pathfinders school until he's 26

you may have to keep paying child support, I would ask whomever helped you arrange your child support or custody arrangements.

If I have been receiving child support from my kids father for 2 years and he has just been approved for social security disability, do I get the back pay from social security like him.

Hi Kizzy,
If he's current on his child support payments, you may not get any extra money from his disability benefits. However, your children may be eligible for auxiliary benefits if your child's father is getting SSDI benefits.

Hi ? Here. I am disabled and have 5 children, I have 3 listed on my benefits and they get survivor benefits which is 1/2 my disability.
Over the last 7 years I worked p/t and paid taxes, I was under the monthly limit so my benefits were never effected.
1. If I pay taxes into social security from my p/t income , can I have my benefits re evaluated, since the cola is minimum at best, I have never seen my benefits go up from what I have paid into social security since I started p/t work. I feel if im paying into it again, my benefit amount should go up and it never does based off what I am putting back in to social security.
2. I have 2 more daughters not on my ssdi, when I went that case worker told me I can add them but it doesn't change the payment amount, but my question to her was, my now 7yr. Old was born with Down Syndrome, a heart defect, and us legally blind in 1 eye, and partially in other. I was told they would take my children's benefits and divide by 5 kids. Om I understand that, but my fight is that it should be divided by 4 kids and she should get her own benefits. I was told I was wrong, now kind you I am there only means of support and way under the financial resource limit for her. Why isn't she eligable for ssi and if she is does she get back pay for 7 yrs since I'm learning the case worker was wrong and she is eligible for ssi. Also is she eligable for ssdi under me for 1/2 my benefit, which would be approx 600 month, or if I file her under ssdi under my disability dies she only get 125 since I have 5 kids 600÷5=125.00 or does it stay 600 ÷4= 150.00
And 1 (her with downs) ÷ 1/2 my ssdi =600

Or am I better off having her filed under my ex wife's benefits since she has worked 30 yrs.
I'm lost and confused with this and have defiantly been misled by caseworker at social
security to discourage me filing for her.

This is critical for me as I am a disabled veteran falling under windfall act, and had to choose ssdi when injured in 2000 because I didn't have enough vested in military for full retirement so my ssdi and medicare was higher and guarnteed insurance for me.

And trying to work with the VA is useless, I get more frustrated than answers from them.
Really can use some help here, thank you

Hi Joshua,
1) Since SSDI benefits are based on lifetime earnings, earning less than your average lifetime earnings would make your benefit amount less.
2) Your child may be eligible for SSI based on your income and resources, but it may be a good idea to see if she may be eligible for benefits based of your ex's work record if your ex is receiving SSDI or retirement benefits.
