SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi Debbie,
It may be a good idea to contact your local SSA office, they may be able to help you with the application for SSI.

Hi Austin,
Deposit times may vary by banking instituition, so I really could not say when it would be deposited and available in your bank account.

I think you should fire your attorneys , because they do not know or they trying to milk the system. I recommend all information that your attorneys work that they have done, to see the progress or if they are doing what you are paying them for. If you feel that you are being miss representative. I would personally report them to the bar association. That is my personnel opinion. Good Luck!!!!!!!!!!

HI There,
This is definitely an option, but it may not be a good idea to go up against an ALJ without an advocate or attorney.

Hi Marcia,
It generally takes about four months from the time you start monthly benefits to receive your first back pay installment.

If I wasn't approved for ssdi when I filed in 2011 and was never offered SSI, but now now reapplied for SSI through my mental health doctor. Is the a chance they would have to pay back payment since 2011? If approved for regular SSI?? Sorry I'm confused. Thanks

Hi Mellissa,
Yes, you may be able to get back pay for SSI, but it is paid in installments rather than being paid as a lump sum.

I filed for disability in 2013 my lawyer at time wouldn't go to federal court w me so I got new lawyer an he had me to file with social security again so does that mean I won't get my back pay from 2013 when I frist filed

Hi Terrsa,
That may be the case, as back pay is paid based on the established onset date (EOD), rather than the date of application.
