SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi Brina,
You may want to contact your local SSA office, but you may have had a reduction in your SSDI back pay if you have been receiving income-based benefits for the time that you had an open application for benefits.

I'm thinking about applying for SSD but , OMG some of these stories I hear how long they have to wait and after applying and still get denied, how scary. I trying to wait as long as I could, but I just can't anymore in too much pain everyday missing work more and more every day because of the pain and affecting my job, I know they are going to fire me soon. I'm only 30 yrs old . will that make a difference ? Should I get an attorney, I will be approved the first time if I do rather than try to do it on my own? please help tell me what to do I will not have a job soon because missing too much work due to how much pain I'm in everyday :(

Hi Sandra,

I am sorry to hear that. Unfortunately it can be a long process, but I would recommend calling the SSA at 1-800-772-1213 to see if they have an update on your claim.

I applied in for SSD in February and got approved in May . So what month I will be receiving the first SSD payment and will I get back money on the first payment? I am getting $1, 182 so if I getting back money on the first payment how much payment will be?

Hi Clyde,
For SSDI benefits, you would have a waiting period of five months before your benefits begin, and then after that you would have to wait four months before you receive your back pay.

I was just approved for partially favorable meaning ill receive back pay for a 13 month period. My question is will I have to wait 6 most for that since I will not be receiving Ongoino benefits?

Hi Brenda,

Congrats on getting approved! However, it's really hard to say when you will get your back pay. I would regularly check in with the status of your claim online with your account with the SSA.

I was told my claim was in the processing center to decide a representative payee what does that mean

Hi There,

It means the SSA is in the process of determining who will be your representative payee.

That mean you need to designate someone as your payer so that they can release your money too.

Carla is right! The SSA will release your benefit to your payee. This person will manage your benefit and make sure it is used for daily living needs, like medicine or rent.

Ssd (the office that decided my back pay)told me that they denied me my back pay. I was awarded my monthly ssd but they won't give me my back pay. Has this happened to anyone else? If so what have you done to get your money back? The social security representative that approved my ssd told me that I would get my back pay from oct 21,2016. My ssd started in may 2017 and has continued each month so far. Thanks

Do you get your normal monthly benefits with your back pay?

I'm thinking about applying for benefits, and heard it was a long process anyways, but from listening to the news, and reading information on the social media websites, they might close the government down in September to save money, my brother just was approved for benefits, will this affect his checks once he starts receiving them, and even make it longer on his back pay?

Hi Brenda,
They may have a government shutdown, however it may not affect his benefits. If you're thinking about applying for benefits, it's a good idea to speak with a disability attorney or advocate about your case as they can help you with the process and help you appeal the SSA's decision if you need to.
