SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. I was approved for ssd then they said I would receive sdi until the ssd kicks in but how long do I have to wait until then.

Hi Trig,
I would guess that you would only need to wait for 2-4 months until you start to receive your SSDI payments and you no longer need your SSI payments.

hi all i applied for disability in 2007 and was denied many times finally in october of 2009 i was approved,i don't know much about how this all works but a friend of mine said to inquire about back pay because i never received any or is it too late to ask about this.Between 2008 and 09 i was pretty much living in icu,im a type 1 diabetic with depression,anxiety and neuropathy in my hands my last visit i was put on a ventihalator.So my question i suppose is am i entitled to back pay or even ssi cause i was not working?Any comments would be appreciated thank you all and God bless

Hi Tre,
If you were not notified about your back pay then, it's likely you are not entitled to it. It's possible you were found "partially favorable" and the judge changed the date of the beginning of your disability due to new medical evidence or something along those lines.

My dad just started receiving social security disability benefits and I'm curious I received a letter saying he will get a certain amount but it doesn't say when and he hasn't been doing well and he really needs the money or we could lose our house

I'm really sorry to hear that. There is unfortunately not a way to expedite payments unless there is a dire medical need, but hopefully you will receive his payments soon.

I was awarded fully favorable back in Aug 2015 after 5 yrs ! I had a wonderful attorney that never gave up. I started receiving my monthly payments Dec 2015. My children have received their back pay but I have not received mine. I have called my local ss office and as of yesterday, I have finally received my award letter. When should I expect my back pay ? Thanks in advance for the help.

Hi Shannon,
It's really hard to tell when you might be receiving your back pay. It will typically come within 4 months of when you start receiving benefits, so I would think that your back pay will arrive no later than the end of April.

I just was approved for disability and the judge said I've been disabled since, 2012, so I just went in front of the judge in 2016, I was wondering when I would start receiving my disability checks and how long before I get my back pay and do you have any idea about how much I will receive inback pay?

Hi Pamela,
You can typically expect to receive your first check within 3 months of you approval. Back pay can come at any time (even before your first check sometimes), but typically will arrive 4 months after you receive your first check.

I was given an award letter stating the amount of monthly benefits I would receive about a month ago. The first payment is 2/24/2016. I applied for SSI, but through advice from a representative I was told that if I wrote a letter withdrawing my application I can expedite the backpay payment. It can be paid out as quickly as 10-15 business days. Do you know if that is true? If not when would someone who withdrew their SSI application never receiving any benefits expect their backpay payment to be processed? I was approved at the reconsideration level.

You can only expedite back pay for an extreme emergency. Examples of this could include a medical situation that's dire, or a situation in which you need to pay rent or you will lose your home and become homeless.

I receive ssdi I already receive some of my back pay how long does it take to get the rest of it I heard it 6 months after receiving the first one

Hi Sharisse,

That will all depend on how long you waited to be approved. If you were approved in less than 5 months, you will not get any. For every month over 5 months that you were not approved, you will be paid however much your disability benefits are per month in one lump sum.

This could be possible if you are on SSI, but they typically split the payments apart into three sections. It is always safer to repay the SSA if they say they gave you an overpayment.
