Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Lina,
I'm not sure how much back pay that you have been awarded, but back pay generally shows up about four months after benefits start being paid. Also, your son will get his back pay while being paid his regular monthly benefits.

Hi Toni,
The SSA enrolls SSDI recipients into Medicare two years after they start receiving benefits. Since your child has been approved in Februrary, he may not be able to be enrolled in Medicare. However, if he is getting SSI, he may be eligible for Medicaid, which has different rules. Here's the SSA's information about Medicaid eligibility:

Okay so my ex husband lost his rights to one of our daughters 2 years ago but I have custody of our other daughter I just applied for derenitive benefits but the social security lady told me that the daughter that he lost his rights to might have to fill out an application because she might be owed money also. My question is if he lost his rights to his children except for the daughter that I have in my custody How would my oldest possibly get half the benefits when two of his other daughters were adopted and they're not eligible?

Hi Dorothy,
I'm not entirely sure what you are asking, but if your ex is getting SSDI, the benefits his and your children would be eligible for would not be affected by your ex being unable to have custody of that child.

Hi. I'm a 16 year old who lives with her grandparents. I was informed by my grandparents that I might have to possibly quit my part time job, for some reason. They receive social security checks each month for me and they believe that those checks could stop being sent to them, because I have a job. They received a letter in the mail stating that they needed to inform social security whenever I
1. Graduated highschool
2. Left the household
3. Started a job
I started working at this job 5 months ago. I wanted to know why the social security checks might stop being sent to them. Is it possibly because I am making more money than the checks they're receiving? Please respond ASAP. I honestly don't want to quit my job.

Hi Callie,
I would not be able to say because I'm not sure of all the details in your specific case, but I do know that letter may not necessarily mean that you would stop receiving benefits if they report that you are working. There may be income limits that you would be subject to because you are getting these benefits, but I would contact the SSA to be sure of what type of benefits maybe getting and what, if any, restrictions on your ability to earn income that may apply. Their number is 1-800-772-1213

My husband started receiving ssdi check on 10/15, our two boys are getting auxillary benefit thru him. Our new baby was born 10/15 and we are going to apply and see if she qualifies. Will she qualify? If so, will she get backpay from 10/15?

Hi Annie,
Congratulations on the new addition to your family!
Your new child may qualify for benefits, and she may also qualify for back pay as well, but the SSA has the final decision on that and they would be able to tell you with certainty. You can call them at 1-800-772-1213.

Hi, I am on SSD I have guardianship of my niece and nephew. I have had them on paper ( notoriety ) since 2011. Through the court systems a year. I received my disability in 2013. Are they eligible to get my disability. There mother is in a long term hospital and their father lives several hours away. We have claimed them on our taxes for years. We are the sole providers for them except for child support from their father. Is there anything we can do. Thanks so much.

Hi Crystal,
You would need to adopt your niece and nephew for them to be eligible for benefits based off of your record.

I have a question..my son's father just got ssi. All his kids also get it. We have split custody, but are son is going to school with me, and also on my medical and foodstamp case. His father is trying to make sure my son's benifets go to him and not to my son here with me. What should I do to make sure my son gets them where he lives.

Hi Ron,
Generally, the custodial parent is appointed the representative payee for a child. I would contact the SSA if you believe that your child's mother would not be an appropriate payee.

Hi Barbara,
She may not qualify. For her to qualify her parents must be dead or disabled, or you would need to legally adopt her.
