SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi Chrissy,
There's a chance! It's not spectacularly high though. Odds are that your back pay won't come for a couple of months after you start receiving benefits.

I applied back in 2010 for my daugher she was denied due to it not being server but I knew my child studder really bad she also had problems with her articulation so that made matters more strussful for me cause i didnt know why she was having trouble speaking complete sentences and failling math n reading terribly as kids her age , prior her teacher and I barely could understand anything she attemted to say (back in 2010 my 1st claim which was denied she was 3ys old inside a Headstart program) in 2011 on 3/18/11 she was placed in speech due to poor/Intelligbilty in contact speech. So i applied aging ,she then started to struggle in school and was held back in kindergarten. So the 2011-2012 school year I applied once more cause her teacher identified her struggles and ask that she be evaluated I started that procces but I then had her remove from public school and place her in private school so she could get more one one attention to help her where she lacks however she had no signs of getting better with her Behavioral in school So I was told to have her evaluated for ADHD by her teachers, so on 9/16/13 she went to the doctor for the ADHD but we had to wait 6 months because her insurance policy.on 9/17/13 again this time for the learning disability she was considered Not eligible. 9/23/13 I request for a hearnig since then she has been diagnosed with ADHD and oppositional disorder I have supporting facts stating that she is disabled and she was place on medication on 3/16 this year and she also has her IEP which concludes a psychiatric in a therapist observation as well as the report from the case examiner from SSA stating that she has a speech delayed I go in front of the ALJ judge on Wednesday do u think I have a chance PLEASE HELP!!!!!

Hi Candi,
I am very sorry to hear that! Fortunately, the ALJ hearing is where you will have your best chance of getting approved. It may be a bit too late, but I often recommend that you speak with an attorney before your hearing to best prepare.

My dad was awarded disability. He passed away before receiving his back pay which is for 3 years. The money was awarded to my brothers and i. I met with the lawyer and provided my routing number. Its been over a month and still no word. The only thing the lawyer has told me is that social security awarded the lawyer fee. It seems as though they're working on it but how much longer?

Hi Rae,
The SSA does take a bit of time to process back pay, it may be a good idea to check with them regarding how long it would be, you can contact them at 1-800-772-1213

Hi there,
there's two types of disability onset dates, there is the Alleged Onset Date, or AOD, which is the date you submit as the date you became disabled. There is also the Established Onset Date or EOD, which is the date that the SSA decides as the date of disability. I think that the date you have may be the date on which you were given a favorable decision by the SSA, rather than either onset date.

Hi Delores,
The SSA usually has a five month waiting period before you'll start getting monthly checks, and you should receive your back pay four months from the time you start getting monthly checks.

I was approved for ssi/ssdi.... I applied in March of 2014 was denied several months later ... Then I reapplied again in April 2015 and got approved for ssi/ssdi on June 2015 and the disability I applied for is what I applied for in 2014 not including the 7 years before that.. My question is why did I not receive or get back pay for ssdi? I've called ss office they had no answer I still don't nderdtand why

Hi there,
You may have been determined ineligible for back pay due to your established onset date (EOD) for disability. If it's the same date that you were approved, you would not be eligible for any back pay.

I had my hearing, got my award letter. I have two different numbers one family benefits you're estimated, then approx. so rate. Back pay starts in Aug. ok now my question is when will I get my monthly payments? Waiting well over two years, along with all the other people who posted on here. I have lost everything, no where to live, changed addresses 10 times in just a year. My kids don't live with me, because when will I put them? So, please this is very frustrating! Will I receive the back pay in August, does the monthly come after that. What are the difference between the two numbers? I don't understand it?

Hi Danielle,
I'm sorry to hear about all that. It generally takes five months from approval to get your benefits, and four months after that for back pay. I would contact the SSA with documentation of your situation (past due bills, ect.) They may be able to expedite your payments based on this information.

Thank you for getting back with me! I have contacted them once already, they had made an error in the first award letter! I don't understand this?? I did speak with my attorney he gave me a rough estimate of SSI backpay for 2999. He not once mentioned to me that I did not qualify for SSDI. I did remember that he said that I did, he just wasn't to sur of the amount?? I have been homeless, careless, jobless, penniless! The his has got to stop! If I'm being misguided I would really like to know! It did specifically say 00.00 you owe. We owe you 00.00 August both parties plainly stated we broke even! I'm confused and done with this, I lost my kids. I'm just not really ready to spend my life living with this disease alone, and begging for scraps! Thank you!!
