SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Hi Margie,
I would not be able to say, but once you receive a decision letter it may specify more about when your benefits will start.

My husband was finally approved for his SSD he is entitled to back pay. He got his first check 06/22/16 when will he get his back pay? His claim was approved May 13th he got the letter

Hi Donna,
Back pay generally comes four months after the you start monthly benefits.

i applied 2012 won fully fave may 4th 2016 got award letterand it saysnothing about my payback award at all! lawyer said id be getting a large amt im scaredas it says under ..why we cant pay past benifits: benifits due dec 2012 thru may 2016 .00 , all zeros plshelp cannot get any answers and among physical pain i sufferfrom extreme anxiety panic attacks thank you

Hi Bev,
You may not have received a fully favorable decision, and as such you may not have been eligible for back pay.

Thank you for your replys .Today i spoke with my DD examiner and told him about my eviction and he said I should receive my determination in the mail by Thursday and i have cleared you medically your claim has been sent back to your local social security office i hope this helps .. whats that mean?

Brian I was denied SSI and SSD they said that we have determined that your condition is not severe enough to keep you from working we considered the medical and other information your age education training work experience in determining how your conditions affect your ability to work you said that you are unable to work because of the following conditions mood disorder attention-deficit/hyperactivity disorder and depression they did not add my generalized anxiety good total evidence of the case File shows that you do have some limitations as a result of the medical impairments noted however these limitations do not Preclude all work in the general economy as is required by this program we do not have sufficient vocational information to determine whether you can perform any of your past relevant work however based on the evidence in the file we have determined that you can adjust to other work if your condition gets worse and keeps you from working right call or visit any Social Security office about filing another application what's this all mean I've decided to hire an attorney for an appeal I have an eighth grade education and a learning disability I was in special education all through grade school I went to ninth and tenth grade but was passed along if I came to class

I am hoping someone can help me. I've been fighting for my social security since 2013 many denials, I was just told Thursday I was approved. How far back will they go?

Hi Richard,
They may go as far back as your Established Onset Date, which is when the SSA decided you became disabled.

Hi there,
generally, back pay is only paid for the time you applied until you start receiving monthly benefits.

Hi,
I was approved for disability on 1/15/2015. I received my first disability check 1/3/16. I'm still waiting on my disability backpay. When I call they tell me 30 days but that never happens. I went in to the social security office and they said mine was complicated because of my disabled son and the passing of my husband in 2014 and my turning 65 the end of July. They said they just started working on it the end of March! I was told each time I call to inquire they put it at the end of the pile of claims! My husband and I worked our entire life. He's gone now and I'm living on $1957.00 a month. Who can live on that amount. I have medical bills in collections and need my backpay!! Need answers!!

You may want to contact the SSA with some documentation showing that you have medical bills in collections, they may be able to expedite your back pay if you have an urgent need for it.

I applied for SSD back on 2/16 just got my denial letter, in the process of hiring an attorney for the appealing process just wanted to know how long before I get a hearing. I'm in California from what I've read this might takes years. Please advise. One last question, because of my disability (SLE,Sjogrens,Fibromyalgia) I stopped working on 6/15 been on disability since then and my last check is schedule for the end of this month my question does the 5 month waiting period still apply to my case?

Hi Kenks,
Hearing times will vary by location, but the average wait time is 17 months currently. The 5 month waiting period is the period you would have to wait after approval rather than anything else.
