SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. I really don't know the specifics of Medi-Cal, so I can't say for sure. I would recommend calling your local SSA office and see if they can provide any clarity.

I have been my disability now for almost a yr, Now been getting calls saying they are from social security, I do not recognize the phone number so do not answer it letting it go to voice mail, the message say the right to work and to sign up. Will social security sending me a recording like that or will they send me information in the mail, so many scams out there I'm scared to answer it, nobody asking for me personally sounds like pre recording messages Just curious of social security does stuff like this or they like the IRS if trying to reach you will send you a letter, thanks

I would recommend looking up the number for your local SSA office. The national number is 1-800-772-1213. If it isn't one of those numbers, it could be a scam.

Filed after career ending injury (2 back surgeries) in 2012. I filed in 2013 I believe and finally met with a judge yesterday. I'm actually no longer disabled (YAAAAAY!!!!) but my attorney believes we have a great shot at the 2-3 year back pay. Totality of the injury was almost 4 years with surgeries and physical therapy. Not expecting anything for a couple months but just curious if anyone has had similar circumstances what the ballpark amount could possibly be. My attorney would only say 'substantial'.

I just received my
award letter. They have figured my back pay amount and the amount owed to my lawyer. The letter stated when
I would start getting my regular monthly payments but it did not say when I would get my back pay. Because it took 4 years to get approved due to a heavy back log in Mississippi it is a substantial amount of back pay which my family needs quickly. When can I expect to receive my back pay?

Hi Brandy,

You usually get backpay within 90 days after approval. If you wish, you could qualify for expedited payments from the SSA.

I applied for Ssdi in June of 2015. Received my back pay in October of 2015 and my first monthly payment in November of 2015. I received my back pay before my first check. I never received anything in the mail. The way I found out was when I checked my bank account online and had a large deposit that I had not made.

Started receiving first ssdi payment on Oct 13th 2017. It is now March 24th and I still have no back pay. Everytime I call SSA they just keep saying it's being processed. It's been 5 months is that normal?

Hello everyone, I had some questions in regards to my SS DI appeal case and was hoping someone could help. Here is just a quick snap shot of my situation: I applied for SS DI in 2014 and 2015 and was denied both times. I applied again in 2016 and was denied but this time I appealed the denial with a lawyer and was awarded ss di on December 2016 with no back pay because of the 5 month waiting period and received by first ss di check May 2017. However, my alleged onset date was 11/01/2013 so I appealed the onset date. My hearing was set for 3/22/18, but the day before my hearing my lawyer contacted me and stated that I did not have to attend the hearing because he just spoke with the AJL and after reviewing my case he granted a fully favorable decision with an established onset date of 12/01/2013. In regards to my back pay since I already had the five month waiting period will I receive the full 3 years of back pay? When I was originally approved for ss di back in 2016 one of my kids had just turned 19 and was no longer eligible for ss di dependent benefits but in 2013 he was 15, so will I receive back pay for him as well automatically or will I have to submit something to SSA? What is the timeframe for receiving award letter and back pay? Thanks in advance for any help.

Hi Bee,

You would generally be approved for backpay that dates back to what your established onset date was.

Since your case is unique, I would recommend speaking with your attorney about the more specific questions regarding your case. Congrats on finally getting approved!

Fully favorable means you have won your disability case AND the backpay date set in your paperwork. Essentially the judge has sided with your date. So you should receive full backpay. I would contact SS on the question regarding your son. Congrats!

I am currently waiting to receive my son's last and final SSI back pay installment. My question is, when they release these final funds to me, am I able to spend it as I please? Or will they say I have to pay it back, or start to take my son's monthly check.

I received the award letter and there was no mention of my back pay although the SSA states that I will be getting a large amount. The question is when? I have been on SSA for six months and still no back pay. I was told nobody can determine when the funds will be release by the processing center by my lawyer. He has also written letters to SSA about my back pay. Can someone answer this question?

I recieved my back pay in three installments.but the months i was payed the bacekpay my current monthly payment never came. Three payments add up to over 2400.00 dollars lost income. I read that they dont include retroactive payments as part as assetts. Why wouldnt i recieve retro and current payment in this situation?

Hello I'm a last child survivor out of my Three brothers who passed ... I was at four years old receiving benefits under my Mom at 9years old walking from school I was innocently shot in a Carjacking shoot out with an Ak bullet tearing my growing Pieces after 9 months of therapy I finally got to be able to walk with 27pins my leg. After my father who was a vet.died of cancer so I started receiving disabled child servivor benefits for 31years now after four years of investigation of me being my deceased Brother.... Congress notified my Local Office who made the mistake of I'm dead.... To immediately Correct the Status and issue me a refund for all the years whitheld.... Now they keep saying payment center haven't notified them back .... Do I need a Lawyer for the release of my family entitlement??? Or ask for a Civil Rights Activist to Help... I lost our home and me and my Mom still waiting for the PC ......how can we request proof of payment center receiving Our local office Notice???

You usually get backpay within 90 days after approval. For SSDI, you should get backpay one lump-sum payment.

I was approved at my hearing on April 4, 2018. When should I expect to hear from the Social Security Office about monthly payments or back pay. I know they have to tell everyone 90 days. I've heard nothing yet and it's been 3 weeks. Anxious !!!

Typically, the first installment of back pay comes about four months after you receive your first payment.

It can sometimes take up to 4 months from your first payment to receive your first installment of back pay.
