Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

I have questions about wether I can remain payee for my little brother. He is a minor and I was approved to be his payee but he now lives with his father and he has gained custody. When I called and let SSI know I asked if could remain payee and they said yes as long as I check in with my little brother and his father to check in on what he needs. Is this true that I can do this? His father claims otherwise and it is creating a big uproar. I understand that any money not spend on him must be put in a sperate savings just for him. Am I going about this the right way, I ask and talk to him everytime I see to

Hi Haley,
Yes, You may be the payee without having custody, and yes, it may be a good idea to keep the funds separate.

I have full guardian ship over my little girl she has not been adopted yet but I've had her since she left the hospital around 2 years. Does she qualify for benefits if I'm on disability

Hi Maria,
If you are receiving SSDI benefits, she may be eligible for benefits based on your work record.

My daughter just turned 19 in may and is attending college full time... They have cut her rsdi saying that now that shes 19 she is no longer eligible even though she aill still be in school full time... Is there anyway around this as she still needs the benefits while attending school

Hi Lisa,
your child may be eligible for SSI based off of his or her disability and their own income and resources. So they may need to apply again as an adult rather than a child.

Hi there,
If your child is otherwise eligible for benefits, then the fact that his father is married may not be a factor.

My daughter turned 18 and her benefits stopped I had been told that as a final check for her it would be a larger amount than normal like a lump sum is this true?

I would not be able to say, but if the SSA did owe any money to your child, then they may send it as a lump sum.

My husband has been disabled for 10+years now and collecting ssd. His 2 daughters who live with there mother get a check for each of them every month. She also gets child support for each child bi-weekly. His oldest turned 18 last august and we just found out the cut off is 18 for the benefits. Do we get refunded that money for the whole year that should have been stopped or is it lost $$ since we didn't know and catch it sooner.?

Hi Heather,
The SSA may ask them for any money that they paid out to the child past the age of 18 under most circumstances, however I am not sure about child support as that would pertain to whatever child support agreements that your husband had made.

I have a child with down syndrome ( trisomy 21) I was reading that she should automatically qualify for Ssi. She was on Ssi , until they said my husband and I make to much money. Medical bills are the issue, even tho we have good insurance. Why do they go off my income when it reads automatic .with the type she has. We both work and still barely make it. A child with special needs should atleast be able to have health care. One trip to doctor , cause she has to go to specialists. End up costing so much even after insurance pays. I can't pay it. Should I reapply for her Ssi. And appeal, if denied. Can't afford a lawyer. I basically have been putting off taking her to doctor. Because of this. Help please

Hi there,
Unfortunately, the SSA does have income limits for SSI along with the qualification criteria for it as well. You may not be eligible based on income.

I have been approved for ssdi after 4 years during that time me and my wife divorced I have two children that from my understanding will receive benefits and back pay. I know my ex wife will get there monthly benefits but my question is does she get all their back pay ?? I only ask because I would like it to go into a trust .

Anyway to stop her from getting the back pack. Again I don't want it , I want it to go in a trust.

You can always ask the SSA to assign a third party as the representative payee, and you may also be able to put it in a trust as well. You may want to call the SSA and let them know that you have reservations about your ex being your child's representative payee.

I'm in Texas and my question is. my sons dad gave up his parental rights so he will no longer have to pay child support. My partner had adopted him. Would my son be able to get RSDI the survivors benefit?
