Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Becky,
Benefits increase for everyone when the cost of living goes up, but I could not say if your child's benefit will ever increase as that is dependent of many factors.

My husband is disabled and drawing Ssdi we have filed for adoption of our two grandchildren. When the adoption is finalized and we go to get them on his benefits how far back will back pay go?

Hi Christine,
It may extend back as far as his established onset date for disability if the children are eligible for back pay.

My husband was recently approved for disability benefits; it was determined that he became fully disabled at the time of his initial accident 6/2011. At the time our youngest son was 16 years old. Would he qualify for back pay?

Hi Amy,
I'm not sure your children would qualify for back pay as SSDI benefits only extend to children of the insured under 16.

My daughter's father gets disability and we are no longer together and my daughter lives with me, i went to the SSA to see about getting benefits for her and i was told that her dad was the only one they could talk to about the case. What do i do?

Hi there,
You may need to contact your daughter's father if you need information from him regarding his case. Alternately you may need his written permission to contact the SSA for his information.

My husband passed almost 3yrs ago pepole telling me my 2 youngest can draw his ssi he nevered worked was getting ssi since he was in school can i is it possible.

I'm sorry to hear about that.
Unfortunately, SSI benefits do not include benefits for children.

My children's father receives SSI so there is not a benefit to my girls, however there is a child support order that he continues to pay occasionally. He now has a terminal illness, if he were to pass would the girls to eligible for benefits?

Unfortunately, I could not say, but if your children's father has a sufficient work record your children may be eligible for benefits based off of that.

I'm disabled on title ll SSD my child receives an auxiliary from this. We are in Florida never married child's father. Went to child support court and her father was deemed to have to pay support and maintain medical ins. At which he did both. The state had his work pay garnished and they got the support money the. Forwarded it on to me. Sadly he has died. How does his support order get fulfilled now? Her needs have not died with him! SSA says she is dual entitled therefore survivors not payable for mine is higher. Seems sooo wrong she is not allowed to have his survivors since it is considered to be only a renumeration of his working. The auxiliary from my record was considered as my income only way a renumeration, as if I were still working. How can on court award child support payments only to have another, SSA take it away? I always believed survivors benefits were replacement funds for children to have continued financial support of the deceased working parent. SSA also stated had he applied before dieing for disability or retirement they would have then been able to garnish those benefits for child support but since he had not and was still actively working they can't. Now not only has child lost him physically child is dual harmed by losing financial support too! I've appealed been waiting 3.5 yrs and we are hurting! Can you aid in advice? See if I died child would have gotten an increase in benefits too!! That's wrong now because it was he child loses out! Sooo wrong!!

Unfortunately, child support may vary by state and the obligation may end when someone dies.

My son is paying child support for 4 children. His ex was on public assistance and recently got her ssd reinstated. I know he has to pay arrears to dss but can he modify his weekly support payments. We are

Hi there,
It's possible, but child support is actually handled by Child Services, not the SSA. His payment plan will completely depend on what the courts order.

I had to receive TANF due to surgery that had to be done immediately in 2013. Things didn't improve and eventually I received ssi while waiting for my ssdi. For a few months I qualified for caretaker supplement for my minor son but was disqualified due to 50 extra dollars in child support. Why didn't anyone tell me, after many inquiries, that I should receive auxillary benefits for him? Can I receive retro child benefits if I apply now? This is crazy!

I am sorry to hear that! Yes, auxiliary benefits can be retroactive so long as your son qualified. I'd recommend scheduling an appointment with the SSA to work that oue.

I am so sorry to hear that! You absolutely should be able to--so long as her mom worked and your granddaughter is under age 18, she should be entitled to surivors' benefits.

My husband has currently been receiving his SSDI for approximately 10 months. We have been providing for our two grandkid financial for about 5 years. What do he need to do to receive a check for them under his SSDI?
