Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Bill,
Your child may be able to receive benefits based off of your wife's SSDI benefits, even if you work.

Hello. I have two kids 18 and 9. They're dad passed away this year. I went to the SSA office to apply for survivors benefits for my 9 year old but I don't have their dad's name on their birth certificate so they told me to get a dna test and come back. So i paid the coroners office to release a sample for testing and it matched. I went back to the SSA office. The guy who interviewed me said I my son will be getting 1k a month. So I left the office and i was so happy that finally I could quit one of my jobs to spend time with my 9 year old who has special needs. I work three jobs and I only see my son 30 minutes in the morning and 30 minutes at night before they go to sleep thats 6x a week. I only spend one full day with them which is Sunday my only day off. After two hours the guy called me and told me that he cannot approve it yet because he needs additional evidence like school, religious, hospital records or letters claiming my kid is his. Court ordered child support which i have none. i didn't file for child support because he was hurting me. Everytime I opened up about putting his name on our kids birth certificate, he'll get mad. When i got pregnant with our first kid, he assaulted me so I ran away. i put him to jail and when he got out, I told him I got an abortion. He's an alcoholic and I was scared for our lives. I told him if try to contact me again,I will call the police. So after seven years he came looking for us. He said he changed. I believed him. And i thought my son needed a father figure. We got back together and i learned that he has another kid. I got pregnant again and the abuse started again. He will not hit me in the face but he twisted my arms, shoved me, called me names in front of our kids. My oldest son started going to counseling because of it. He started abusing alcohol again. Sometimes he will steal from us. Steal my money and pawn our oldest son gadgets for alcohol. When i told him several times that i will file for child support, he'll said it will ruin his life and told me he don't what he will do to me if i did. i have several police report and no contact orders. I officially ended it when he put my 2 year old in a car while he was heavily drunk. I applied for government assistant but they want me to name their father so they can go after him for child support and i beg them not to make me because I was scared. I know he will not harm my kids but I wanna stay alive for them. Ive been supporting our kids. Even my ex family is willing to write a letter saying my kids are his and i have pictures and a letter from him through Facebook saying that he loves his sons and he was sorry but SSA told me they cannot accept it as supporting evidence. On section 1712 of their hand book it says if paternity was establish they can accept letter from relatives and friends saying the kids are his but this guy told me they want proof that my kids are his dependents. Im the sole provider of my kids but that doesn't mean we we are not struggling. His other kid is already getting the benefits but mine are still in the back seat.Is there hope for my kid to get approved?

Hi Rhea,
I'm sorry to hear about all that! Yes, your children may be eligible for benefits,it may be a good idea to contact the SSA's national line regarding this, you can do that at 1-800-772-1213.

On August 22, 2016 I was informed that my daughter qualified for benefits from her father SSDI case. I recently received information from child support that the have been informed that my daughter qualifies to receive benefits and that I should apply. I applied in August of 2016. I then received a letter requesting income verification for the amounts received from SSI. I have received none. Upon speaking to Social Security to find out the status of my daughters claim they informed me that “other” family members have not responded to documentation requests and my daughters claim will pend indefinitely or until they respond. The “other” family member is the ex-wife and her children. Is this accurate?

Hi Lisa,
I cannot say if that is accurate because we are not affiliated with the SSA or the federal government, and we do not have access to information on claimants.

I was just told that my SSDI claim was approved. I understand that since I initially filed 21 months ago, I will be receiving back pay minus the standard 5 months that is taken back automatically. I also have 2 daughters one of which turned 18 and graduated HS 11 months after I filed. Will she get back pay for the 6 months leading up to graduation? My second daughter is 16 and I am going to assume she will be getting a portion for the 6 months with my first daughter. And then the remaining 9 she will get back paid for? My estimated benefit was given too me by SSA when I filed. Can I assume that amount is what I will be getting plus any COLA increases last year and this year? While I would much rather be working and not have the issues I deal with on a daily basis, this insurance was paid for and I do not feel bad about taking them. Thanks ahead of time. Merry Christmas and a Happy New Year

Hi Steve,
Auxiliary benefits end at 16 years old, so your 18 year old may not be eligible for back pay, and your 16 year old may only be eligible for benefits for about 7 months at maximum.

Hi Jenine,
If she was on the application when he had applied, she may not be able to get back pay any farther than that.

My daughter want's this as well. Mom out of self interest will want lump sum, I AM NOT PICKING ON HER. Do I need to stop this and if so How. We have both met with SS and applied. I requested Myself, Mom's son or my sister as payee for lump sum. I do see my daughter everyday and available 24/7

Hi Dan,
You do not need to give your child's lump-sum back pay to your ex, you do have the option of allowing a third party to manage it.

I have custody of my four year old granddaughter, who has recently been diagnosed with Respiratory Airway Disease. Would she be eligible to receive disability benefits?

I have been on disability since 2008. I recently married to a man who has sole custody of his 11 year old son. I was told I had to want until our first anniversary before I can apply for benefits for my step-son. Will I receive back pay for the year I had to wait?
