SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi there,
the SSA is a massive organization, so sometimes it might feel like they're a little indifferent. However, don't worry, it just takes time for your back pay to arrive.

Hi Lisha,
They may do the installments because it is easier for them to do that than arrange large transfers on money once.

My husband has been fighting for SSI since 2010 for medical reasons with no lawyer, so he's been denied 2x then the last time he re-applied he got eligible fast within 5 months. Before he even received his first check, he got a check for 2100, I think they said that was all his back pay, but fighting 7 long years and only 2100 that doesn't seem right. I understand they can only go back a yr or two, but still 2100 remember he had no one to pay because he fought by himself, no lawyer. Can we request retroactive.

Hi Marie,
Unfortunately, because he re-applied he would only be eligible for back pay from the time of his application, not the time he first became disabled.

I will get my first SS disability on Aug 17 2016 but no sign of my back pay yet. Is there something specific I should ask SS when I call to ask about it? Would my lawyer know? I got my acceptance letter and it said how much back pay Im getting. My lawyer has been paid.

Hi Susan,
Back pay usually comes four months from the time of your first monthly disability check.

Well its been the four months that you said since I started receiving benefits. I have called them a lot but now it shows my backpay is in review? Does that mean Im closer to getting it? Thanks

Hi Susan,
As we are not affiliated with the SSA or the Federal Government, I really could not say how close you are to getting your back pay.

Hi Janelle,
It may be a good idea to contact the SSA about this, they may be better able to clear up this issue that you're having with back pay.

My father got approved for his disability and right before he was about to receive his first check he passed. I was told by his lawyer that my siblings and I would receive his back pay. I've filled out all the required paperwork to receive what our father left us. It seems Social security continues to give me the run around on the status. When will those funds be issued? Or normally how long do it take?

Hi Trish,
I am very sorry to hear that. Yes, you will be eligible for his back pay. You should receive it around four months after his payments were scheduled to start.

Hi Raymond,
Your first installment of back pay will probably come around four months after your payments start, although it could be a little faster (or even slower).

My daughter is 21 and had her ssi hearing that lasted 15 minutes.is that good or bad?
Riverside, CA | Sunday at 11:11am
my daughters ssi hearing lasted 15 min.. the judge swore them in, the atty started asking my daughter questions, the judge NEVER asked her anything but did ask the VE 2 questions and the hypotheticals regarding all of her mental limitations im assuming from the drs whodas form and letters and records they obtained which seemed strong.the VE said no jobs are available with all limitations.the atty gave no closing statement only and opening one... she is 21 and with all of this , why didnt the judge ask my daughter anything and since it was so short, is that a good thng?.. the atty didnt have time wth us before or after the hearing cause they said they are running off schedule... we seemed rushed...your opinion on the shortness and what i stated is appreciated... tyAVING SAID ALL OF THAT THEY SAID JUDGE MADE DESICION IN 4 DAYS... IS THAT GOOD OR BAD ALSO... HER ATTY WONT CALL BACK CAUSE SHE SAID AFTER THE HEARINGS THEY DONT TALK TO US OFTEN... I NEED AND ANSWR PLEASE TY

Hi Elizabeth,
Generally response times depend on the location that you're having the hearing, the complexity of the case, and other factors. Because of this, I really can't say if this sort of response is positive or negative.
