SSDI length of time for back pay?

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. I first applied back in 2011. I never saw anything back from social security so I just assumed I didn't qualify. Well, they sent the packet to my parents home and I just got it from my mom today, September 2016!! So it said I qualified but needed additional info. I filled it all out and just mailed it back in.. What should I expect to happen?

I was injured at work and covered under Worker's Comp. In April 2012 I got a lump sum from the Work Comp injury. I tried going back to work, but since that time my health has declined and in September 2013 I was forced to quit working. Some of my pain is related to the prior work injury, but not all, as I now have other medical issues. In February 2016 I was approved for SSDI and was asked if I had received any Worker's Compensation benefits from Sept 2013 through Feb 2016 and I told the SSA that I hadn't, but that I did in 2012. Social Security has now reduced my monthly benefits from $783 to only $27 a month and informed me that I am now responsible for paying back all of my back pay. Is there anyway that I can fight this? I was honest with them and told them about receiving money almost 2 years prior to the dates they asked. Is there a time frame for receiving Work Comp lump sum and Social Security Disability benefits?

Hi Dee,
If you had income based benefits, then you may have been ineligible for them based off of the lump sum you had received from the SSA.

I was told that SS checks to see if you received federal SSI before they send your backpay out to you. I didnt receive any. My lawyer has contacted them and told them this. They say my backpay is just sitting there. Why wont it be released to me?

Hi Sue,
If you were recently approved, the SSA does have a five month waiting period for SSDI and then you would receive your back pay about four months after beginning SSDI benefits.

Hello I was hospitalized in 2007 . applied for disability and denied. I have been diagnosed with major depression since 2011. I recently applied again. Does anyone think I will be approved since I have a Dr diagnosis and have been seeing him throughout the years.

You may be approved if you are able to demonstrate an inability to work because of your condition.

I am on Social Security disability and receiving my monthly checks. However I also received an award letter for backpay that I have as yet to receive. I was told it could take up to five months. It is going on around nine months. Is there a lengthy amount of time that I do not receive the backpay that I should take legal steps for them to Pay up? And if so what legal steps would that be?

Hi Annette, generally it takes about four months after you start receiving benefits to receive your back pay. Also, if you used a lawyer to help with your case, you may want to speak with them and the SSA regarding your back pay.

Hi, my husband just got a fully favorable decision from a hearing judge 25 days ago and today (9/21)his benefits updated on mySocialSecurity and it has his back pay listed as a one time payment for yesterday (9/20/2016)
Does that mean they already mailed the check?
Yes, a check-not a single person told us we could add DD ...

Hi Kimberly,
Back pay generally comes around four months after you start receiving monthly benefits. Even though it is listed as yesterday, it may be that that is just the back pay being entered into their system, rather than the check being mailed.

My initial lawyer binder and binder was fired by me. My second attorney and I went to the court and we have a fully favourable decision. This was Dec 10 2015. I stared receiving monthly benefits in Feb. It's not Sept 25 2016 and retro pay still has not come in. I call them once a month I get told call back next month. Anyone who has a similar experience any advice?

Hi Dave,
It is possible that you may not have been eligible for back pay, or alternately that the amount of back pay was only able to cover your lawyer's fees. Because you used multiple lawyers, it is possible that you were obligated to pay both, and payment comes out of back pay.

Its been over 120 days. I havent got my back pay. The local ss office doesnt know why. They are willing to isdue a small amount to me while waiting. Is thete interest or penalty they pay for taking so long
