SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi there,
If you're getting SSDI benefits, then it should start about five months from now. If you're receiving SSI benefits, then it may take until the start of next month.

I had never heard this. What are all the agencies that can take your back pay? Is there a link to a list online? I'm curious because my back pay is late.

Hi Christine,
I am not aware of any other agency other than the SSA being able to take back pay benefits, either.

Hi Jeff,
I really could not say what your chances are exactly, but having legal representation always helps!

Hi again.. my doctor just sent my attorny a letter stating my conditions and what's wrong but also stated that I cannot work full time 8hrs a day 52 weeks a year.. and that I would need short days with extra breaks and accommodation.. is that what I needed

Grrr.. I'm going on 11 month of waiting for a hearing.. I was denied twice prior.. and I had also filed 2 times before that and was denied, but at that time I wasn't really seeing a doctor reregularly.. now I am at least every two months.. doctor did give attorney letter stating her opinion that I cannot work full time 8hrs a day 52 week a year.. and if I did work it have to be short days with extra breaks.. I cannot drive due to my medical problems, I do not even have my license.. I'm in pain every day.. I'd hate to know what the pain will be when I'm older.. the average wait time here in sacramento is 17 months I believe and I'm going on 11, hopefully Ill hear something soon.. I do have a attorney.. my attorny filed for hearing on 2/17/16, my original application date is 6/19/15 and my onset date is 7/05/13... thanks everyone.. I'm just stressing alot..

Hi Jeff,
Hang in there! The fact that you've got a hearing date seems pretty promising. Good luck!

Hi Connie,

Generally it takes around four months for back pay to arrive after the start of monthly benefits.

Best Wishes,
Eric

Hi Dave,
I'm sorry to hear that! Sometimes the wait times may vary based on where you apply for benefits.

Hi Laura,
I am sorry to hear that you still have not received your back pay. When did you receive your first disability check? Back pay usually comes within 120 days of receiving your first check, although sometimes it can take longer.
