Hi Dianne,

Hi Dianne,
This is completely impossible. Your daughter is very misinformed.

Joann
I have full custody of my

I have full custody of my great niece and nephew can they draw from my disability check

Hi Joann,

Hi Joann,
They cannot, unless their parents are deceased or disabled, or unless you legally adopted them.

I just got granted permanent

I just got granted permanent / full disability. I am married with two teenagers and my husband now has to be with me full time. Is he eligible to draw any type of income and if so what percentage? And what percentage would each of my children be eligible to receive? They will both be out of school in two years. Will my husbands percentage change then?

Hi Teresa,

Hi Teresa,
Your husband will not be able to receive any benefits. This is because SS benefits are for people with disabilities, not caretakers. Your children could be eligible for up to 50% of your benefits if they are under age 18, however.

My kids receive ssi

My kids receive ssi disability and live with me. I do not work. Their dad wants to claim them on his taxes. Will that affect my kids ssi?

No it will not.

No it will not.

My daughter was diagnosed

My daughter was diagnosed with autism when she was 4 years old, she is now 16. She received benefits for about 1 year and a 1/2 (when she was in elementary), some of which they want me to pay back now. I reapplied last year and was denied because of resources, even after the appeal. My ex husband and I own 2 houses, but I live in one- we have been separated for almost 3 years. Should I wait until I am divorced to reapply? Am I supposed to have nothing in my name to insure she qualifies? Does my daughter qualify for backpay? She has missed out on so many years of therapy and assistance because we have not been able to afford the help she needs.

Any insight on this would be helpful. Thank you in advance.

Hi Dee,

Hi Dee,
Yes, I would wait until you are divorced. This is because a second home is counted as assets against an SSI applicant. And she will not qualify for back pay--that starts at the most recent application.

Single Mother of 2
I have been separated for 4 1

I have been separated for 4 1/2 years. I am legally married to him still. My ex was just approved for Disability.
He hasn't paid me anything since he walked, will my daughters be able to receive any benefits from his disability?
Will I be able to get any kind of back pay? My oldest daughter is a teenager and my youngest is about to start school. I work fulltime though. Just sitting here and wondering about what I should do and the steps that I should take at this point in time......Thanks for any help that I can get

Hi there,

Hi there,
Yes, they will. So long as they're both under age 18, they can receive up to 50% of your ex's disability benefits. If your ex is entitled to back pay, your children will be too.

noe

Hi Noe,
You do not. They will be included on the application.

My daughter received a lump

My daughter received a lump sum back pay check based off my SSD in 2015, however all of the money was for previous years 2011,2012,2013, none of the money was for 2014 or 2015. Is this going to be taxable to her on her 2015 tax return? She gave the money to me since she was under 18 during those years. I've tried to find answers with no luck

No, SSD benefits are not

No, SSD benefits are not counted as taxable income so long as they're less than $26,000

Miko
my daughter and I were both

my daughter and I were both receiving SSDI (her father passed away and was on disability
She just turned 16 earlier this month. My check stops. Will she get the added difference from what I was getting, like she would of when her dad was alive? She probably will be qualified for disabled due to mental issues but need to find out if she will get the difference

Hi Miko,

Hi Miko,
I am sorry to hear that. Her balance will likely go up, but it will not make up the difference. Spouses and children can only earn up to 50% of a deceased beneficiary's record.

Hi my kids father is disabled

Hi my kids father is disabled and draws a check. Ok his name is not on my kids birth certificate but he did state he put the down when he applied for it but we don't receive anything...would I have to go apply for my kids and what all do I need of he isn't on the birth certificate

Hi Anjerica,

Hi Anjerica,
You will need to go to your local SSA office to see if he's receiving benefits in the child's name, and if so, to get the benefits in your name instead.

hi,im just curious as can be

hi,im just curious as can be I hope you can clear this mess up for once and for all where do I start. My girlfriend whos been on ssi disability that's raised her granddaughter since she was three who hasn't been recieveing no support or child bennifits other than food stamps which keep getting smaller by the month isn't she entitled to some kind of relieif but probably to late for that.next question, the two of them live in a sec.8 hud housing complex just sent her a letter telling her that she would have to pay the full amount of rent since she got a mimium wage part time job (less 20hrs ) shes 18 but still lives there but still in high school.Isnt there some kind of waiver or exemption clause for this? and last but not least.she has never filed a tax return for her because she let her adoptive parents fool her and tell her that it would be better if she let them claim her even though she live under her roof with all expences paid for.Isnt that fraud? thanks so much

Hi Chris,

Hi Chris,
She would be, if the daughter is either disabled herself, or if the child's parents are both disabled or deceased.
As for section 8 housing, I unfortunately have no idea. We only specialize in SS benefits.
And you actually not need to file taxes for Social Security benefits if your total payments are less than $26,000 per year, which is certainly true for her if she's on SSI.

Can someone apply for

Can someone apply for survivors benefits for their child if they do not have a valid social security number? The child does have a valid SS# but the parent doesn't. The decided parent had a valid Ss#

Hi there,

Hi there,
I don't think so...if the parent never had a Social Security number, the SSA will not be able to grant any benefits based on work history.

my child's father who

my child's father who passed away had other children. I was told that if their mother didn't get them survivors benefits with in 1 1/2 yes of their fathers passing that I would be able to apply for the benefits so my child can get the full amount. They divided his benifits in 3 since he had three children. My child is getting her monthly benefits already..the other children are not receiving anything. Is this true?

Hi there,

Hi there,
This is very strange and I have never heard of this. All children under age 18 should be receiving a portion of his benefits.

My ex recently began receiving disability. Our children live with me. Are they eligible to receive any benefits through his disability?

Hi there,

Hi there,

if my husband is disables and i get a check for the kids can i file taxes

Hi there,

Hi there,
You will not need to file taxes for SS disability benefits.

Dawn
My daughter is 33 and has MS

My daughter is 33 and has MS she is going to apply for disability. Someone told me since I get her deceased fathers Social Security if she is granted disability it will be taken from what I get from her fathers SS. Is this true?

Hi Dawn,

Hi Dawn,
Maybe...if she had MS before age 22, she could qualify for 50% of her deceased father's benefits. I hope this helps!

Lynn
My kids dad went legally

My kids dad went legally blind at the age of 17, Didnt work at all in his short life. He has passed last year on May 13. I was told that my kids should have been able to receive his disability checks. Is that possible?

Hi Lynn,

Hi Lynn,
I am so sorry to hear that! But they are not eligible for benefits if he did not work at all.

Rita

My Husbund 68 just went this yr from Ssdi to ss I am 52 do not wk ! We have had legal guardianship of our granddaughter sence 2006 but she has been living with us sence she was one she is no 11 ! I was told we could get ss Ben for her so today I called and was told yes was given a ref # no Gn-00306.235 I don't know if I wrote it down wrong or what ? Everything I read says parents must be dead or disabled ... There are both just deadbeat and we have fully supported her with no help at all them or the state ! I can't find anything that says yes other then the ladie on the phone today at ss she we would get 1200.0 a mo for her if we provide 51 percent of her care well how do u prove that ? Does this make sence ? Are we going to get it and is there along wait? She mad appt for us at the local ss office please help

Hi Rita,

Hi Rita,
If the parents are both disabled, your granddaughter could be eligible for benefits as well. Otherwise, there is not much you can do.

sally

My husband receives disability. my question is I have custody of our 4 year old grandchild for a couple of years.does grandchild qualify for a dependent and back pay from time of court order for my custody.does child count as step child

Hi Sally,

Unfortunately not, unless you adopt the child or if the child's parents are deceased or disabled.

If my child father has ssi

If my child father has ssi check can my daughter get one behind him

No, your daughter cannot.

No, your daughter cannot. This is only for children of parents on SSDI.

My son is disable and receive

My son is disable and receive benefits, what I want is this his father just received his disability can my son draw from him to because he nevered payed any support my so is now 14 years old

Hi Merylin,

Hi Merylin,
Your son could receive 50% of his father's payment, but only if his father is on SSDI and only if 50% of his father's payment is higher than your son's own payment.

Kathy Gill
My brother has begun

My brother has begun receiving SSDI. He has 3 children by his ex-wife, teenagers and they all live with her. She applied for benefits for the children, which will be more than his child support payments if and when their application is processed. He has borrowed from me to keep paying child support. He would like to know when she begins to receive benefits, so he can stop paying her, but she refuses to talk to him. The Social Security office says they can't tell him when the kids begin receiving payments. This seems wrong, that he is not entitled to know when he can stop sending child support payments. Meanwhile, she's being paid double for the children. She's always been about the money, so no surprise there, but what should my brother do? Thanks.

Hi Kathy,

Hi Kathy,
There is unfortunately not a lot you can do about the child support. This is because Child Services and the SSA are not connected. Child Services can re-evaluate how much he pays for child support, but there's nothing the SSA can do in this matter.

Troy
My Ex wife receives SSI for

My Ex wife receives SSI for my son that was diagnosed with Autism since he was 4 years old and he is fifteen.
but lives with me 50% of the time. am I eligible for part of that money and think she says he lives with her full time

Hi Troy,

Hi Troy,
This may be something you have to work out with your wife, because the SSA cannot split payments between different bank accounts.

Yvonne
