Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

My daughter is 33 and has MS she is going to apply for disability. Someone told me since I get her deceased fathers Social Security if she is granted disability it will be taken from what I get from her fathers SS. Is this true?

Hi Rita,
If the parents are both disabled, your granddaughter could be eligible for benefits as well. Otherwise, there is not much you can do.

Hi Sally,
Unfortunately not, unless you adopt the child or if the child's parents are deceased or disabled.

Hi Merylin,
Your son could receive 50% of his father's payment, but only if his father is on SSDI and only if 50% of his father's payment is higher than your son's own payment.

My brother has begun receiving SSDI. He has 3 children by his ex-wife, teenagers and they all live with her. She applied for benefits for the children, which will be more than his child support payments if and when their application is processed. He has borrowed from me to keep paying child support. He would like to know when she begins to receive benefits, so he can stop paying her, but she refuses to talk to him. The Social Security office says they can't tell him when the kids begin receiving payments. This seems wrong, that he is not entitled to know when he can stop sending child support payments. Meanwhile, she's being paid double for the children. She's always been about the money, so no surprise there, but what should my brother do? Thanks.

Hi Kathy,
There is unfortunately not a lot you can do about the child support. This is because Child Services and the SSA are not connected. Child Services can re-evaluate how much he pays for child support, but there's nothing the SSA can do in this matter.

Hi Troy,
This may be something you have to work out with your wife, because the SSA cannot split payments between different bank accounts.
