Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

I was recently medically retired from the military. I applied in June while I was on active duty but on paid leave. My established onset date was moved to August, after I became
retired. Is it likely an appeal will move my EOD to June if I prove i was no longer working. Also I just applied for aux benefits for my children. Will their payments start after my 5 month waiting period or at a different time?

Hi Mil,
I unfortunately cannot answer that question! The judge who reviews your claim will be the one who establishes your onset date. Your children will receive benefits as soon as you do.

I applied for Social Security Disability in April of this year. Denied once, now waiting on reconsideration. I have 2 children. One lives with me full time and the other I get part time. There is no custody agreement. Can both of my children get benefits? Or just the one living with me?

Hi Alayna,
Both of your children are eligible for funds, but their parent may be the one responsible for the funds of the child who you don't have full custody of.

Thank you for responding so quickly! As far as benefits for my kids go, does the payment go to me or is it like a check made out to my child in their name?

Hi Alayna,
The SSA does not actually send paper checks anymore. You'll receive the payments directly into your bank account. You should set up a new account specifically for these funds.

my husband died i want to collect survivor benefits for my son as his step father was his main form of financial support however my sons biological father is the custodial parent. can i be the payee of my sons checks as it is my husbands finances that are gone or will they go to the custodial parent my son is 5

Hi J,
This is a tricky question, but I believe the answer is yes, so long as you and your deceased husband were married for at least a year. You should call the SSA at 1-800-772-1213 to discuss how to file this claim.

I am applying for ssa benefits. I had biopsy done at North Western Hosp. By Dermatologist. Results. Behcets Syndrome. My Doctor, Gynaecolist has seen the ulcers in mouth, tongue, vaginal, & inflamed ulcers inside vaginal area, muscles hurt, & Psychologist Has me on meds for anxiety,& Depression. The psychologist typed a letter stating my diagnosis, & not able to do regular daily routines. Shld I see if the doctors, & gynaecolist will also type letter since they seen all of my ulcers, & flare ups? Hard for me to talk , swallow, sit, walk, urinate, & muscles hurt. I'm in excruciating pain!!! I also work 4 days waitressing. Do I need to quit my job to qualify? I get child support for 2 of my children $228. Every 2 weeks is this considered income? I have a ph interview Tues. Dec. 22. Ssa asked me how many children under 18? They're names age and date of birth. Why? I dnt make over $800. at job. Ive had to call weeks at a time off even received checks that say voided on them. Thank you for taking the time to read this ,& respond. I'm grateful, & appreciate this. I pray I get approved.

Hi there,
Child support will NOT count as earned income and will not disqualify you for SSDI benefits. But if you are working, you will likely need to quit your job to qualify. You cannot earn more than $1090 per month in 2015 to qualify for disability benefits.

Hello im currently over 18 and will be awarded a sum from a parents disability claim. The back pay that I will receive from that claim is intended to be money for me or for my parent?

Hi Jerome,
This is a difficult question. I believe it should go to your parents, because it would have been awarded to you as a minor, when you were eligible for auxiliary benefits. Your parents will likely be able to spend it on your behalf as they see fit.

So I'm confused. If it should go to my parents why is it deposited to my banking acct. I understand that if I was under 18 it goes to them to manage for me. I'm 19 can't I manage the back pay funds thats being deposited to me for myself such has college for example. So I guess I'm still asking am I to just hand over the sum to my parents or am I to manage the money (its going towards college not blowing it) myself. I mean the money regardless of who holds it is supposed to be used towards me right?

The money was deposited into your own bank account? Then I would assume that you are able to spend it on your needs as you wish.

Since the age of 4, My son was receiving ssi from his deceased father. I was just approved for ssdi and will b receiving back pay. He's 19 now but was 17 at the time when I became disabled will he get back pay for that year?

Hi there,
Your son may not be eligible for benefits as he was receiving the survivor's benefits at the time you had applied.

Not really sure what you're asking here. SSI benefits are for people who have never worked, so it makes sense that he's receiving SSI.

I have custody of my brothers children. I have had them for apx 14 years. They are 15 and 16 now. Their father receives social security disability and 4$ in SSI benefits. Not sure what or where biological mother is. But she is not considered disabled. What I was wondering is would they qualify for any benefits? I do not ever receive child support but do get state funds called TANF. Not even close to enough to properly care for 2 children.
